Фінансування недержавного соціального забезпечення в Україні

Abstract

У статті розглядається правове забезпечення фінансування недержавного соціального забезпечення як один із важливих критеріїв при виокремленні його в якості самостійної організаційно-правової форми соціального за- хисту населення наряду із: соціальними ризиками, які слугують підставою для такого забезпечення; колом осіб, яким надаються заходи підтримки у вигляді матеріальних і нематеріальних благ, які охоплюються поняттям «вид соціального захисту»; власне видами соціального захисту та порядком їх надання. Висвітлюються точки зору українських та зарубіжних науковців щодо доцільності виокремлення даної форми в системі соціального захисту України на сучасному етапі її розвитку. Через два блоки недержавного соціального забезпечення, виокремлені автором дослідження: недержавне пен- сійне забезпечення та благодійну та подібні до неї види діяльності, розкривається порядок фінансування досліджу- ваної форми соціального захисту населення. Акцентується увага на тому, що, найбільш чітко охарактеризувати механізм фінансування видається можливим саме через недержавне пенсійне забезпечення, відносини із якого достатньо врегульовані. Визначається також, що, враховуючи те, що джерелом фінансування іншого блоку заходів із недержавного соціального забезпечення є усі, не заборонені законом джерела, відмінні від коштів державного бюджету, ними являються кошти окремих юридичних та фізичних осіб. Крім цього, зазначається, що заходи соціального забезпечення за рахунок даної форми соціального захисту населення можуть надаватися і за допомогою використання грошей, які надійшли в порядку трансфертів, що до- водить існування змішаного джерела фінансування. Висновком до дослідження слугує авторське визначення джерел фінансування, яке основане на видах недер- жавного соціального забезпечення, які існують в Україні. The article deals with the legal provision of financing non-state social security as one of the important criteria in distinguishing it as an independent organizational and legal form of social protection of the population along with: social risks that serve as a basis for such provision; the number of persons receiving support measures in the form of tangible and intangible benefits, covered by the concept of “type of social protection”; actually types of social protection and the procedure for their provision. The points of view of Ukrainian and foreign scientists on the expediency of isolation of this form in the social protection system of Ukraine at the present stage of its development are highlighted. Through two blocks of non-state social security, identified by the author of the study: non-state pension insurance and charitable and similar activities, the procedure for financing the investigated form of social protection is revealed. Attention is drawn to the fact that the most clearly described mechanism of financing is possible because of non-state pension, the relationship of which is sufficiently regulated. It is also determined that, given that other non-statutory sources of funding for another block of non-state social security measures are the funds of individual legal entities and individuals. In addition, it is noted that social security measures at the expense of this form of social protection of the population can also be provided through the use of funds received in the order of transfers, which proves the existence of a mixed source of financing. The conclusion to the study is the author’s definition of sources of financing, which is based on the types of non-state social security that exist in Ukraine.
