Правові проблеми децентралізації в природоохоронній сфері

Abstract

У статті розкриваються правові проблеми реалізації державної реформи децентралізації контрольно-наглядової функції в природоо- хоронній сфері. З’ясовано, що така децентралізація складається з двох завдань: 1) передачі низки контрольно-наглядових повноважень Державної екологічної інспекції органам місцевого самоврядування; 2) організація діяльності природоохоронних інспекторів (екологічних шерифів) на базі територіальних громад. Встановлено порушення термінів законодавчого врегулювання зазначених питань, а також не- ефективність передачі контрольно-наглядових повноважень на місцях громадським екологічним інспекторам. The article reveals the legal problems of implementation of the state reform of decentralization of control and supervision functions in the environmental sphere. It is revealed that such decentralization consists of two tasks: 1) the transfer of a number of control and supervisory powers of the State Environmental Inspectorate to local self-government bodies; 2) organization of activity of environmental inspectors (environmental sheriffs) on the basis of territorial communities. The violation of the terms of the legislative regulation of these issues, as well as the ineffectiveness of the transfer of control and supervision powers on the ground to public environmental inspectors, is established.
