Інтерпеляція як засіб парламентського контролю уряду в контексті легітимізації влади: європейський досвід

Abstract

У статті висвітлено використання інституту інтерпеляції в країнах із різними формами правління для виконання функції політико-парламентського контролю – над виконанням і реалізацією законів урядом, відповідності його дій очікуванням пересічних громадян. Оскільки політична система України трансформується в напрямі парла- ментарно-президентської моделі, доцільність упровадження цього інституту потребує всебічного аналізу його функціонування. Проаналізовано практику використання інтерпеляцій у Німеччині, Фінляндії та Франції, яка свідчить, що цей інститут має потужний легітимізаційний потенціал, який у системі розподілу влад парламент використовує для обмеження свавільних дій уряду через інтерпеляції, наступні дебати та юридично обов’язкові рішення з питань шляхом спонукання уряду діяти в межах політичних і правових норм, реалізовувати політику й закони, установлені парламентом, утверджувати засади конституціоналізму. Світова тенденція до збільшення використання інтерпе- ляцій свідчить про попит, що зростає, на підзвітність, прозорість, послідовність, ефективність урядової політики в рамках правової держави. Показано, що інтерпеляція – ефективний важіль впливу опозиції, має вагоме легітимізаційне значення як засіб урахування інтересів меншості в урядовій політиці, засіб висвітлення та реагування на нагальні явища, події, про- блеми, факти протиправної діяльності чи бездіяльності уряду задля донесення їх до громадськості, виявлення латентних факторів проблем, окреслення альтернативних варіантів рішень, подальшого вдосконалення урядового курсу, як результат, відновлення чи збільшення довіри населення до влади – легітимність. Інтерпеляція в разі її використання задля голосування недовіри до уряду, який зневажає права і свободи громадян, також сприяє легіти- мації влади. В Україні видається перспективним запровадити цей інститут відповідно до рекомендацій Венеційської комісії, проте обов’язково з конструктивним вотумом, чітко відмежувавши інтерпеляцію від депутатського запиту. The article highlights the use of institute of interpellation in most countries of the world, not only with the parliamentary form of government for the fulfillment of information function and political and parliamentary control – over the implementation and realization of laws by the government, its compliance with the expectations of ordinary citizens. As the political system of Ukraine is transforming in the direction of the parliamentary-presidential model, the expediency of this institute introducing requires a thorough analysis of its functioning. The practice of using interpellations in Germany, Finland and France shows that this institute has a powerful legitimizing potential that parliament uses in the system of distribution of powers to limit arbitrary government actions through interpellations, further debates, and legally binding decisions on issues through compelling to act within the framework of political and legal norms, implement the policies and laws established by Parliament, uphold the foundations of constitutionalism. The worldwide tendency to increase the use of interpellations speaks about growing demand for accountability, transparency, consistency, and the effectiveness of government policy within the rule of law. It is shown that the effective lever of influence of the opposition ‑ interpellation has considerable legitimization value as a means of taking into account minority interests in government policy, as a means of highlighting and responding to urgent phenomena, events, problems, facts of illegal activity or inactivity of the government in order to bring them to the public, illustrating issues latent factors, outlining alternative solutions, further improving the government's course, and as a result, restoring or increasing public confidence in the government – legitimacy. In case using it for no confidence voting against government that abuses citizens' rights and freedoms, interpellation also helps to legitimize power. In Ukraine, it seems promising to introduce this institute, in accordance with the recommendations of the Venice Commission, with a constructive vote, making difference between the interpellation and the deputy inquiry.
