Погроза як підстава визнання правочину недійсним

Abstract

У статтi розглядається категорiя погрози, як пiдстави визнання правочинiв недiйсними. Розглядаються та аналiзуються точки зору вчених вiдносно погрози як такоi' та спiввiдношення погрози i завдання реальної шкоди. Наведенi теоретичнi визначення погрози, види погрози тощо. Аналiз наведених позицiй та чиннот нормативнот бази, присвяченот регулюванню цього питання, дозволяють автору ви­явити специфiку правочинiв, вчинених пiд впливом погрози.

There аге the theoretical definition of threats, types of threats, etc. Analysis of the positions and the current regulatory framework dedicated to the regulation of this issue, allows the author to identify specificity of transactions committed under threat.
