Система джерел цивільного права України: сучасний стан та перспективи розвитку

Abstract

Стаття присвячена дослiдженню сучасного стану системи джерел цивiльного права України та визначенню тенденцiй її розвитку. Ви­значена тенденцiя до збiльшення кiлькостi джерел цивiльного права, зокрема формально закрiплених на рiвнi ЦК України. Наголошусть­ся на необхiдностi узгодження теоретичних та практичних аспектiв проблематики та напрацюваннi єдиного niдходу до системи джерел цивiльного права України, який би враховував не тiльки здобутки тeopii та судової практики, але й iсторичнi передумови формування цiєї системи, соцiально - економiчнi, полiтичнi умови iснування в державi, сучаснi тенденцii правозастосування, зокрема рiвень розвитку праворозумiння в суспiльствi.

The article is devoted for researching of the modern state of the system of sources of civil law of Ukraine and decision of its progress trends. Tendency to the increase of amount of sources of civil law, in particular formally envisaged at the level of Civil Code of Ukraine is substantiated. Тhе necessity of concordance of theoretical and practical aspects of range of problems and making of the one going is marked near the system of sources of civil law of Ukraine, what would take into account not only the achievements of theory and judicial practice but also took into account historical pre-conditions of forming of this system, socially аге economic, political terms of existence in the state, modern tendencies of using of law, in particular level of development of understanding of law in society.
