Історичні передумови формування сучасної системи джерел міжнародного права

Abstract

У статті розглянуто ключові аспекти формування сучасної системи міжнародного права. Окрему увагу приділено роботам вчених XVII-XVIII століть та їх впливу на формування системи джерел міжнародного права на початку ХХ століття та на формулювання тексту статті 38 Статуту Постійної палати міжнародного правосуддя, редакцію якої було збережено і в Статуті Міжнародного Суду ООН.

The article deals with key aspects of the modern system of international law. Special attention is paid to the studies of ХVІІ-XVIII centuries scientists and their influence on the formation of sources of intemational Іаw in the early twentieth century, first in the Statute of the Permanent Court of lnternational Justice, in particular Article 38, which later passed unchanged to the Statute of the lnternational Court of Justice.
