Проблеми впливу на особу глобалізаційних проявів сучасної правової реальності

Abstract

У статті розглядаються проблеми впливу на особу глобалізаційних проявів сучасної правової реальності. Визначено, що рівень впливу залежить від багатьох факторів, основними серед яких, на думку авторів, є два чинники: культура особи та її ментально-національні ідентитети. Аналіз наукових джерел і власне бачення проблем трансформації соціально-правового простору дали нам можливість виділити такі прояви місця та ролі особи в умовах глобалізації: новизна соціально-правових явищ, у яких формується ідентичність особи; усвідомлення особою власної ідентичності не тільки в межах держави, але і як «громадянина світу»; підвищення рівня толерантності особи в умовах глобалізації суспільства; розквіт екстремізму; значний потенціал особи у формуванні політичної та правової реальності.

The article deals with the problems of the impact on the person of globalization manifestations of modern legal reality. It is determined that the level of influence depends on many factors, the main among them, according to the authors, are two factors: the person’s culture and its mentally-national identities. The analysis of scientific sources and my own vision of the problems of the transformation of the social and legal space have enabled us to distinguish the following manifes tations of the place and role of a person in the conditions of globalization: the modernity of social and legal phenomena in which the identity of a person is formed; awareness of the person of his/her own identity not only within the state, but as a “citizen of the world”; increasing the level of tolerance of a person in the conditions of globalization of society; the flowering of extremism; significant potential of a person in forming political and legal reality.
