Захист прав дитини в Україні як загальнотеоретична проблема

Abstract

У статті акцентується увага на необхідності пізнання вітчизняною загальнотеоретичною юридичною наукою проблеми прав дитини, яка не стала предметом комплексного дослідження. Аналізується законодавство та практика національних судів щодо забезпечення прав дитини. Обґрунтовується висновок, що права дитини мають стати предметом комплексного загальнотеоретичного дослідження, що дасть змогу сформувати цілісну та всебічну концепцію прав дитини, яка допоможе вивести діяльність із забезпечення прав дитини на якісно новий рівень, та яка буде ґрунтуватися на загальноєвропейських положеннях щодо розуміння цього соціального явища.

The article focuses on the necessity of knowledge of rights of the child by the national general and theoretical legal science, which did not become the subject of a comprehensive study. The law and practice of the national courts regarding the rights of the child provision are analyzed. It is concluded that the rights of the child should be the subject of a complex general and theoretical study, which will help to form a holistic and comprehensive concept of the rights of the child, which, in its turn, will allow to bring the activity on ensuring the rights of the child to a qualitatively new level and which will be based on the European provisions regarding the understanding of this social phenomenon.
