Система елементів права на справедливий суд

Abstract

У статті надано класифікацію основних елементів права на справедливий суд. Визначено їх як засади судочинства. На основі системного аналізу норм міжнародного та національного законодавства, а також рішень Європейського суду з прав людини, розкрито зміст елементів права на справедливий суд.

Classification of the main elements of the right tо а fair trial is made in this article. Тhеу defined as the principles of justice. On the basis of systematic analysis norms of international regulations and national laws, as well as of the European Court of Human Right's judgments, the content elements of the right to а fair trial are determined.
