Краткий осмотр (реферат): | The article examines the duty of a person to strictly abide by the Constitution of Ukraine and the laws of Ukraine, not to encroach on the rights and freedoms, honor and dignity of others. Emphasis is placed on the difference between human responsibilities and the responsibilities of a citizen, as well as on the fact that not all provisions of the Constitution of Ukraine, which, as noted in the doctrine of constitutional law, enshrine human responsibilities, and illustrated in the context of research 1 st. 57 of the Constitution of Ukraine enshrines the guarantee by the state that everyone should know their rights and responsibilities, and not the obligation to know them. It is established that Article 68 of the Constitution of Ukraine enshrines two human responsibilities: 1) to strictly abide by the Constitution of Ukraine and the laws of Ukraine; 2) not to encroach on the rights and freedoms, honor and dignity of others. It is revealed in which constitutional prohibitions the obligation of everyone to strictly observe the Constitution of Ukraine and the laws of Ukraine is specified (part 3 of article 13, part 4 of article 17, part 6 of article 17, part 7 of article 17, part 1 of art. 19, Article 23, Part 2, Article 24, Article 37, Part 4, Article 41, Part 5, Article 41, Part 6, Article 41, Part 6, Article 55, Part 2, 3 , 4 Article 126 of the Constitution of Ukraine), as well as the provisions of the Constitution of Ukraine, which developed the obligation of man not to encroach on the rights and freedoms, honor and dignity of others (Part 3 of Article 24, Part 2 of Article 27 , Part 3, Article 27, Part 2, Article 28, Part 3, Article 28, Part 1, Article 32, Part 2, Article 32, Part 8, Article 41, Part 3, Article 43, Part 5 of Article 43, Part 6 of Article 43, Part 3 of Article 44, Part 4 of Article 44, Part 3 of Article 47, Part 2 of Article 54, Article 64 of the Constitution of Ukraine). It is established that the duty to strictly abide by the Constitution of Ukraine and the laws of Ukraine is a duty of man and the constitutional prohibitions in which it develops are constitutional prohibitions against man, and the duty of everyone not to encroach on the rights and freedoms, honor and dignity of others. and belongs to the duties of man, but develops in the provisions of the Constitution of Ukraine, a number of which narrow the range of holders of these responsibilities only to the circle of citizens of Ukraine. |
