Методологія наукового пізнання процесів глобалізації та трансформацій як факторів розвитку та універсалізації прав людини нових поколінь

Abstract

Розкрито глобалізаційні процеси та трансформації як об’єктивну тенденцію інтернаціоналізації різних галузей життя сьогодення на міжнародному рівні, формування у цьому незворотному процесі нових правових відносин на рівні національного і міжнародного прав та їх тісному взаємозв’язку і взаємо доповненні, утворення прав нового покоління. Розуміння цих процесів і їх наслідків сприяє методологія наукового пізнання як парадигма історичного розвитку цивілізації людства. Встановлено, глобалізаційні процеси та поява нових прав людини діалектично взаємопов’язані, взаємодоповнюючі та взаємозалежні в розвитку людської цивілізації, утворення нових соціально-правових інститутів мирного співжиття і розвитку без будь-яких дискримінацій. Визначено, глобалізація — це рушійний домінантний фактор еволюції прав людини в напрямі: 1. Трансформації наявних прав. 2. Розробки нових прав із розширеним змістом. 3. Визнання та закріплення нових прав. 4. Універсалізації нових і трансформованих прав на міжнародному рівні. 5. Інноваційних підходів до вдосконалення механізму реалізації прав та їх захисту на міжнародному рівні. 6. Утворення нових правових інститутів на принципі партнерства і паритетності з метою співіснування/співжиття і розвитку людської цивілізації без різних видів дискримінації та вирішення проблем, що мають ознаки загальносвітового рівня і планетарних викликів. Таким чином теорія глобалізму/глобалізації зайняла суттєве місце у сучасній науці та політиці. Осмислення глобалізації повинно здійснюватися з таким же розумінням значення для світового розвитку у ХХІ столітті, як капіталізм для ХІХ століття, імперіалізм для ХХ століття. Це – глибинні процеси, що перетворюють світ права.

Globalization processes and transformations are revealed as an objective trend of internationalization of various branches of today’s life at the international level, the formation of new legal relations at the level of national and international rights in this irreversible process and their close interconnection and complementarity, the formation of the rights of a new generation. The understanding of these processes and their consequences is facilitated by the methodology of scientific knowledge as a paradigm of the historical development of human civilization. It has been established that globalization processes and the emergence of new human rights are dialectically interconnected, complementary and interdependent in the development of human civilization, the formation of new socio legal institutions of peaceful coexistence and development without any discrimination. It has been determined that globalization is a driving dominant factor in the evolution of human rights in the direction of: 1. Transformation of existing rights. 2. Development of new rights with expanded content. 3. Recognition and consolidation of new rights. 4. Universalization of new and transformed rights at the international level. 5. Innovative approaches to improving the mechanism of rights implementation and their protection at the international level. 6. The formation of new legal institutions based on the principle of partnership and parity with the aim of coexistence/coexistence and the development of human civilization without various types of discrimination and solving problems that have signs of a global level and planetary challenges. Thus, the theory of globalism/globalization has taken a significant place in modern science and politics. The understanding of globalization should be carried out with the same understanding of its significance for world development in the 21st century as capitalism for the 19th century and imperialism for the 20th century. These are deep processes transforming the world of law.
