Abstract

У статті проаналізовано специфіку правового забезпечення соціальної функції держави як явища. Деталізовано його зміст та сутність. Зазначено, що дослідження механізму правового забезпечення соціальної функції держави є неможливим без визначення його структурних елементів. Виокремлено перелік елементів механізму правового забезпечення соціальної функції держави. Нормативно-правове забезпечення соціальної функції держави, що проводиться завдяки створенню норм права й відповідних нормативно-правових актів у соціальній сфері, що регулюють поведінку суб’єктів правовідносин. Суб’єкти надання забезпечення соціальної функції держави Варто зазначити, що кількість таких суб’єктів обумовлюється варіативністю напрямів діяльності, завданнями та колом повноважень, що передбачені у законодавстві. Механізм правового забезпечення є залежним від правового регулювання та водночас тісно пов’язаний із фінансовими ресурсами держави та сучасним уявленням населення про гідне життя. Виділенні елементи механізму правового забезпечення охоплюють відображають різноманіття напрямів втілення соціальної функції та ілюструють важливість спільних цілей та завдань для належної взаємодії.
