Поняття економічної основи місцевого самоврядування та її організаційно-правове забезпечення в умовах війни в Україні

Abstract

У статті проаналізовано поняття економічної основи місцевого самоврядування. Зокрема, зазначено, що визначальне значення у змісті даного поняття має його соціальна спрямованість, пов’язана з орієнтацією на задоволення потреб місцевих жителів. При цьому серцевину економічної основи місцевого самоврядування становить система об’єктів муніципальної економіки – рухоме і нерухоме майно, доходи місцевих бюджетів, позабюджетні цільові (у тому числі валютні) та інші кошти, земля, природні ресурси, що є у комунальній власності територіальних громад. Також, у статті наголошено, що російська збройна агресія в Україні, розв’язана 24.02.2022 р., призвела до колосальних втрат для економіки держави. Внаслідок бойових дій бізнес та бюджети усіх рівнів недоотримують мільйони гривень доходів. У зв’язку з цим зазначено, що надзвичайно важливо надати громадам більше ефективних інструментів для наповнення бюджету, одним з яких є залучення органів місцевого самоврядування до адміністрування місцевих податків, що сприятиме, за умови реалізації відповідних законодавчих ініціатив, зростанню податкових надходжень до місцевих бюджетів щонайменше на декілька сотень мільйонів гривень на рік. Крім того, у статті акцентовано увагу на тому, що повномасштабна війна, розгорнута російською федерацією, суттєво вплинула на пріоритети розвитку територіальних громад в Україні, перенісши їх з площини забезпечення сталого і ефективного економічного розвитку у площину гарантування безпеки для своїх жителів та економічного «виживання». Проте, після закінчення активної фази війни перед владою постане складний виклик щодо швидкої та ефективної відбудови країни, відновлення економіки та продовження муніципальної реформи, розпочатої 2014 році. Зроблено висновок, що дуже важливим та непростим завданням держави і місцевої влади сьогодні, в умовах воєнного стану, є подолання наслідків російського збройного вторгнення, відновлення зруйнованої промислової та іншої інфраструктури, вміла організація роботи місцевого господарства та комунального сектора економіки на основі належного організаційно-правового та матеріально-фінансового забезпечення.

The article analyzes the concept of the economic basis of local self-government. In particular, it is stated that the determining importance in the content of this concept is its social orientation, which is related to the orientation towards meeting the needs of local residents. At the same time, the core of the economic basis of local self-government is the system of objects of the municipal economy - movable and immovable property, revenues of local budgets, extra-budgetary targeted (including currency) and other funds, land, natural resources that are communally owned by territorial communities. Also, the article emphasizes that the russian armed aggression in Ukraine, unleashed on February 24, 2022, led to colossal losses for the state’s economy. As a result of hostilities, businesses and budgets of all levels are not receiving millions of hryvnias in revenue. In this regard, it is stated that it is extremely important to provide communities with more effective tools for filling the budget, one of which is the involvement of local selfgovernment bodies in the administration of local taxes, which will contribute, subject to the implementation of relevant legislative initiatives, to the growth of tax revenues to local budgets at least for several hundred million hryvnias per year.In addition, the article focuses on the fact that the full-scale war launched by the Russian Federation sig-nificantly affected the development priorities of territorial communities in Ukraine, moving them from the plane of ensuring sustainable and effective economic development to the plane of guaranteeing security for its residents and economic “survival” . However, after the end of the active phase of the war, the authorities will face a difficult challenge regarding the rapid and effective reconstruction of the country, the recovery of the economy, and the continuation of the municipal reform that began in 2014. It was concluded that a very important and difficult task of the state and local authorities today, in the conditions of martial law, is to overcome the consequences of the Russian armed invasion, restore the destroyed industrial and other infra-structure, skillfully organize the work of the local economy and the communal sector of the economy on the basis of proper organizational, legal and material and financial support.
