Адміністративні процедури у сфері адміністративно-правового забезпечення науково-технологічного розвитку в Україні

Abstract

Статтю присвячено визначенню та характеристиці адміністративних процедур у сфері адміністра-тивно-правового забезпечення науково-технологічного розвитку в Україні. Схарактеризовано види адміністративних процедур в означеній сфері: 1) управлінські процедури полягають у прийнятті загально-адміністративних (стратегічних) та індивідуально-секторних управлінських рішень, спрямованих на повномасштабне адміністрування науково-технологічного розвитку; 2) реєстраційні процедури дозволяють легітимізувати правовідносини науково-технологічної діяльності шляхом вчинення реєстраційних дій, обліку суб’єктів та об’єктів науково-технологічної діяльності та внесення відповідної інформації до адміністративних баз даних; 3) організаційно-кадрові процедури – це процедури призначення, переведення, звільнення, заохочення, стажування, підвищення кваліфікації, атестації суб’єктів науково-технологічної діяльності з метою забезпечення належної кадрової політики у сфері науково-технологічного розвитку; 4) дозвільно-ліцензійні процедури забезпечують функціональну реалізацію науково-технологічного розвитку шляхом видачі уповноваженими органами влади спеціальних дозволів (ліцензій) на здійснення визначеного виду науково-технологічної діяльності з метою застосування легалізованого контрольного впливу на науково-технологічну сферу; 5) контрольні процедури полягають у здійсненні контролюючими суб’єктами публічної адміністрації владно-перевірочної, інспекційної та наглядової діяльності з метою дотримання усіх вимог науково-технологічної діяльності та розвитку науково-технологічної сфери; 6) процедури інтернаціоналізації полягають у включенні міжнародних аспектів в науково-технологічну діяльність в Україні, адаптації вітчизняних результатів науково-технологічної діяльності до міжнародних вимог, створенні стійких міжнародних науково-технологічних зв’язків; 7) процедури цифровізації полягають у використанні суб’єктами публічної адміністрації електронного інструментарію розробки нових баз даних, автоматизації обробки інформаційних даних, прийнятті цифрових рішень і загальному впровадженні цифрових технологій в адміністрування науково-технологічної сфери.

The article is devoted to the definition and characteristics of administrative procedures in the field of administrative and legal support of scientific and technological development in Ukraine. The types of administrative procedures in the specified area are characterized: 1) management procedures consist in the adoption of general administrative (strategic) and individual sectoral management decisions aimed at full-scale administration of scientific and technological development; 2) registration procedures make it possible to legitimize the legal relations of scientific and technological activity by taking registration actions, recording subjects and objects of scientific and technological activity and entering relevant information into administrative databases; 3) organizational and personnel procedures are procedures for the appointment, transfer, dismissal, promotion, internship, advanced training, certification of subjects of scientific and technological activity in order to ensure the proper personnel policy in the field of scientific and technological development; 4) permitting and licensing procedures ensure the functional implementation of scientific and technological development by issuing special permits (licenses) by authorized authorities for the implementation of a certain type of scientific and technological activity with the aim of applying legalized control influence on the scientific and technological sphere; 5) control procedures consist in the implementation by controlling entities of the public administration of power-checking, inspection and supervisory activities in order to comply with all the requirements of scientific and technological activity and development of the scientific and technological sphere; 6) the procedures of the internationalization consist in the inclusion of international aspects in scientific and technological activity in Ukraine, adaptation of domestic results of scientific and technological activity to international requirements, creation of stable international scientific and technological ties; 7) digitization procedures consist in the use by subjects of public administration of electronic tools for the development of new databases, automation of information data processing, digital decision-making and the general implementation of digital technologies in the administration of the scientific and technological sphere.
