Судова реформа та розвиток принципів цивільного процесуального права України

Abstract

Статтю присвячено аналізу впливу змін, внесених Законом України «Про судоустрій і статус суддів» до цивільного процесуального законодавства, з точки зору їхнього впливу на розвиток принципів цивільного процесу України. Зазначається, що прийняття вказаного закону являє собою розвиток в цивільному процесі принципів гласності, законності та оперативності розгляду справ. В цьому зв'язку обговорюється створення автоматизованої системи документообігу судів, скорочення процесуальних строків та новий статус рішень Верховного Суду України.

The article is dedicated to the analysis of the impact of the amendments introduced in Ukrainian civil procedure law bу the new Law.of Ukraine on Judicial Organization and the Status of Judges, especially with respect to its impact on the development of the principles of civil procedure. The article notes that the adoption of the said changes manifests the development of the principles of legality, openness, and expeditious disposition of cases. ln this connection the automated court documentation system, shortening of the procedural time limits, and the new status ofthe decisions of the Supreme Court are discussed.
