Національно-конституційна модель ідентичності як запорука консолідації українського суспільства

Abstract

У статті досліджено взаємозв’язок між конституційною та національною ідентичністю та націй основі сформовано національно конституційну модель ідентичності, окреслено її особливості з урахуванням можливостей консолідувати українське суспільство. Акцентовано на тому, що лише гармонійне поєднання «духу народу» та універсальних цінностей конституціоналізму є гарантією розвитку сучасної національної конституційної держави. Конституційні принципи можуть оптимально реалізуватися у соціальній практиці лише у контексті історії нації, у тісному зв’язку із національно-ментальними установками її представників, а відтак становлення громадянського суспільства – спільноти вільних і рівноправних осіб. Доведено, що Конституція України є результатом генезису основних конституційних принципів в національному контексті, який надав її особливого забарвлення. Це дозволило задовольнити по-треби нації відповідно до її національної ідентичності, а також відповідно до напрямку такої еволюції, її динаміки, продиктованих історією держави. Отже, конституційна ідентичність є особливою колективною ідентичністю нації, що визначена чи сформована Конституцією. Висновується, що національна конституційна ідентичність – це комплекс національних правових цінностей та особливостей конституційного ладу, які водночас консолідують громадян в одну націю та відрізняють державу від інших держав, міжнародних і регіональних інституцій чи народів світу. У розвитку національної конституційної ідентичності значну роль відіграють: національний аспект, доктрина конституційного патріотизму, основоположні конституційні цінності, та Конституція України як вище джерело ідентичності.

The article examines the relationship between constitutional and national identity, and on thisbasis, a national constitutional model of identity is formed, its features are outlined, taking intoaccount the possibilities of consolidating Ukrainian society. It is emphasized that only a harmoniouscombination of the “spirit of the people” and the universal values of constitutionalism is a guaranteeof the development of a modern national constitutional state. Constitutional principles can beoptimally realized in social practice only in the context of the nation’s history, in close connectionwith the national-mental attitudes of its representatives, and hence the formation of civil society - acommunity of free and equal persons.It is proved that the Constitution of Ukraine is the result of the genesis of the main constitutionalprinciples in the national context, which gave it a special color. This made it possible to meet the needsof the nation in accordance with its national identity, as well as in accordance with the direction of suchevolution, its dynamics, dictated by the history of the state. Therefore, the constitutional identity is aspecial collective identity of the nation, which is defined or formed by the Constitution. It is concluded that the national constitutional identity is a complex of national legal values and featuresof the constitutional system, which at the same time consolidate citizens into one nation and distinguish thestate from other states, international and regional institutions or peoples of the world. In the developmentof national constitutional identity, the national aspect, the doctrine of constitutional patriotism, fundamentalconstitutional values, and the Constitution of Ukraine as the highest source of identity play a significant role.
