Цифрова трансформація в судовій системі України

Abstract

Пандемія COVID-19, повномасштабне вторгнення російської федерації на територію України зумовили значні перешкоди у роботі судової системи України, в тому числі, проведення судових засідань в приміщеннях судів. Питання цифрової трансформації в аспекті проведення судових засідань онлайн є малодослідженим, з точки зору науки. Цифрова трансформація створює нові та унікальні можливості для усіх сфер життя суспільства. За допомогою цифрових інструментів ми можемо фактичного відмовитися від ведення документообігу в паперовому варіанті, вести ділові переговори та зустрічі онлайн, перебуваючи, навіть, на різних континентах. Не оминули ці зміни і судову систему України. Так, з кінця 2017 року у судах діє Єдина судова інформаційно-телекомунікаційна система, що дозволяє подавати процесуальні документи, проводити судові засідання в дистанційному режимі. В роботі ми більш детально розглянемо порядок проведення судових засідань в режимі відео конференції поза межами приміщення суду. Учасники справи мають право брати участь у судовому засіданні в режимі відеоконференції поза межами приміщення суду за умови наявності у суді відповідної технічної можливості, про яку суд зазначає в ухвалі про відкриття провадження у справі, крім випадків, коли явка цього учасника справи в судове засідання визнана судом обов’язковою. Учасники справи беруть участь у судовому засіданні в режимі відеоконференції поза межами приміщення суду з використанням власних технічних засобів та електронного підпису згідно з вимогами Положення про Єдину судову інформаційно-комунікаційну систему та/або положень, що визначають порядок функціонування її окремих підсистем (модулів). Цифро-ва трансформація сприяє економії часу та коштів, так як учасники процесу не повинні витрачати час та кошти на приїзд до суду, певною мірою сприяє забезпеченню екологічної безпеки, оскільки зменшення випадків користування транспортом призводить до менших викидів в повітря продуктів палива, дозволяє учасникам процесу, особливо, адвокатам, більш продуктивно використовувати та планувати свій робочий графік, з тих підстав, що, не витрачаючи час на проїзд, а відвідуючи судові засідання онлайн, у власному кабінеті чи іншому приміщенні, адвокат не витрачає час на дорогу і, відповідно, може взяти участь у більшій кількості судових засідань.

The COVID-19 pandemic, the full-scale invasion of the russian federation on the territory of Ukraine caused significant obstacles in the work of the judicial system of Ukraine, including the holding of court hearings in court premises. The issue of digital transformation in the aspect of conducting court hearings online is poorly researched from a scientific point of view. Digital transformation creates new and unique opportunities for all spheres of society. With the help of digital tools, we can actually abandon paper-based document management, conduct business negotiations and meetings online, even on different continents. The judicial system of Ukraine did not miss these changes. Thus, since the end of 2017, courts have been using the Unified Judicial Information and Telecommunication System, which allows submitting procedural documents and holding court hearings remotely. In the work, we will consider in more detail the procedure for conducting court hearings in video conference mode outside the court premises. The participants in the case have the right to participate in the court session in the mode of video conference outside the premises of the court, provided that the court has the appropriate technical possibility, which the court notes in the decision to open the proceedings in the case, except for cases when the appearance of this participant in the court session is recognized by the court mandatory The participants in the case take part in the court session in videoconference mode outside the court premises using their own technical means and electronic signature in accordance with the requirements of the Regulation on the Unified Judicial Information and Communication System and/or the provisions determining the order of functioning of its separate subsystems (modules). Digital transformation helps to save time and money, since the participants in the process do not have to spend time and money on coming to the court, to some extent helps to ensure environmental safety, since the reduction in the use of transport leads to less emissions of fuel products into the air, allows the participants in the process, especially, lawyers to more productively use and plan their work schedule, for the reasons that, without spending time traveling, but attending court sessions online, in their own office or other premises, the lawyer does not waste time on the road and, accordingly, can participate in more court hearings.
