До проблем розвитку спортивних правовідносин в Україні

Abstract

Спортивні правовідносини в Україні перебувають на стадії становлення. Їх розвиток супроводжується рядом чинників, котрі ускладнюють, а інколи й унеможливлюють формування сучасної, стабільної системи, відтворення моделей спортивних правових відносин за прикладом провідних світових та європейських держав. До таких чинників варто віднести недосконалу систему законодавства у сфері спорту, відсутність злагодженого та продуктивного механізму співпраці сторін спортивних правовідносин, недостатнє матеріально-технічне забезпечення, низький розвиток спортивної індустрії, відсутність механізму залучення населення до регулярних занять фізичною культурою, недостатня кількість висококваліфікованих кадрів, застаріла та неефективна спортивна інфраструктура для занять спортом або взагалі її відсутність, зокрема, спортивних споруд, які б відповідали міжнародним стандартам та ін. У роботі акцентується на тому, що Українська держава, повинна дбати про розвиток фізичної культури і спорту, створювати та налагоджувати механізми урегулювання спортивних правовідносин, піднімати престиж країни на міжнародній спортивній арені. З огляду на це, запропоновано ряд тенденцій розвитку та вдосконалення спортивних правовідносин в Україні. Зокрема, щодо розподілу повноважень в частині управління спортивними організаціями, федераціями, ефективного та прозорого розподілу бюджетних коштів із залученням інших джерел фінансування спорту, будівництва нової, а також реконструкції та ремонт наявної спортивної інфраструктури у відповідності до міжнародних стандартів, розробки механізмів розвитку мережі дитячо-юнацьких спортивних шкіл та спортивних клубів різної форми власності, забезпечення умов для фахового навчання та підвищення кваліфікації конкурентно-спроможних спортивних менеджерів, налагодження тісної співпраці з мас-медіа з метою популяризації спорту тощо.

Sports legal relations in Ukraine are at the stage of formation. Their development is accompanied by a number of factors that complicate, and sometimes make impossible, the formation of a modern, stable system, the reproduction of models of sports legal relations based on the example of the leading world and European states.Such factors include the imperfect system of legislation in the field of sports, the lack of a coordinated and productive mechanism for the cooperation of the parties to sports legal relations, insufficient material and technical support, the low development of the sports industry, the lack of a mechanism for involving the population in regular physical education, an insufficient number of highly qualified staff, outdated and ineffective sports infrastructure for sports or its absence at all, in particular, sports facilities that would meet international standards, etc.The article emphasizes that the Ukrainian state should take care of the development of physical culture and sports, create and establish mechanisms for regulating sports legal relations, raise the country’s prestige in the international sports arena.Considering this, a number of trends in the development and improvement of sports legal relations in Ukraine have been suggested. In particular, regarding the distribution of powers in the management of sports organizations and federations, the effective and transparent distribution of budget funds with the involvement of other sources of sports financing, the construction of new, as well as the reconstruction and repair of existing sports infrastructure in accordance with international standards, the development of mechanisms for the development of a network of children and youth sports schools and sports clubs of various forms of ownership, provision of conditions for professional training and professional development of competitive sports managers, establishment of close cooperation with the mass media for the purpose of popularizing sports, etc.
