Класифікація видів публічного адміністрування за критерієм територіального масштабу

Abstract

Мета статті – скласти класифікацію видів публічного адміністрування за критерієм територіального масштабу. Мета публічного адміністрування полягає у максимальному забезпеченні інтересів фізичних та юридичних осіб у всіх сферах життєдіяльності суспільства і держави, і створенні на цій основі умов для сталого розвитку політичних, економічних, соціальних, екологічних, інформаційних та інших видів суспільних відносин, в яких може бути досягнута максимальна реалізація здібностей, задатків і прагнень громадян. Вказана мета вимагає створення теоретико-методологічних та правових підстав реалізації вказаних концептів та місцевому рівні У статті розглянуто особливості об’єкта місцевого самоврядування. Простежено наслідки реформи адміністративно-територіального устрою в Україні. Визначено роль територіальних громад у вирішенні питань публічного адміністрування в державі. Розглянуто вплив реформи адміністративно-територіального устрою на фінансове забезпечення територіальних громад. Окреслено зміни у системі надання адміністративних послуг населенню. Акцентовано увагу на тому, що новели Закону України «Про внесення змін до деяких законів України щодо впорядкування окремих питань організації та діяльності органів місцевого самоврядування і районних державних адміністрацій» від 17 листопада 2020 року № 1009-IX, які передбачають уведення такого суб’єкта адміністративно-територіального устрою, як територіальні громади, суперечать положенням ст. 133 Конституції України, відповідно до якої визначено систему адміністративно-територіального устрою України.

The purpose of the article is to determine the classification of types of public administration according to the criterion of territorial scale. The article determines that the goal of public administration is to maximize the interests of individuals and legal entities in all spheres of the life of society and the state and, on this basis, create conditions for the sustainable development of political, economic, social, environmental, informational and other types of public relations. This goal requires the creation of theoretical, methodological and legal foundations for the implementation of these concepts at the local level The article considers the features of the object of local self-government. The consequences traced the reforms of the administrative-territorial structure in Ukraine. The role is determined by the territorial communities in resolving issues of public administration in the state. The impact of the reform of the administrative-territorial structure on the financial support of territorial communities is considered. Changes are indicated in the system of providing administrative services to the population. Attention is focused on the fact that the novels of the Law of Ukraine «On Amendments to Certain Laws of Ukraine on the regulation of certain issues of the organization and activities of local governments and district state administrations» dated November 17, 2020 No. 1009-IX, which provide for the introduction of such a subject of administrative-territorial structure as territorial communities, contrary to the provisions of Art. 133 of the Constitution of Ukraine.
