Гіпермодерн і соматичні права людини

Abstract

Стаття присвячена одній із актуальних тем сучасності – природі соматичних прав людини та причинам їх виникнення. Використовуючи історико-філософську методологію, критичний аналіз сучасних культурологічних, антропологічних і соціальних теорій, контекстуалізм та соціокультурний підхід, автор визначив проблемне поле дослідження – формування соматичних прав людини як наслідок глибинних культурологічних процесів, які характерні для другої половини ХХ-початку ХХІ століть. Автор наполягає на тезі про те, що роль держави у закріпленні прав людини є вторинною в порівнянні із культурогічними процесами, які відбуваються у суспільстві (за допомогою права держава може формалізувати та юридично закріпити лише те, що стало надбанням суспільної свідомості і практики). Поява та специфіка соматичних прав людини в статті розглядаються в межах гіпермодерну як сучасного стану розвитку суспільства. Взявши за основу новітні культурологічні та антропологічні дослідження західних вчених, автор доводить, що тіло сьогодні наділяється винятковим статусом та особливою значущістю на противагу попереднім епохам, для яких характерним було закріплення цього статусу за Індивідом, Людиною. Наш час, який може позначатися термінами «гіпермодерн», «код кіборга» тощо є контекстом, в межах якого відбулася остаточна емансипація людини від багатовікових обтяжень релігійного і світоглядного характеру в частині права людини на власне тіло. Автор підкреслює, що сучасні соматичні права представляють собою відкриту систему, оскільки вони мають н-нну варіативну природу, яка, значною мірою, підсилюється здобутками четвертої промислової революції, зокрема і частині нано- та інформаційних технологій. Доведено, що соматичні права людини як один із видів «нових» прав людини пов’язаний із людиноцентристською парадигмою у правознавстві. Юридичне закріплення соматичних прав як права розпорядження («самовласності») своїм тілом уможливило процеси вдосконалення,модифікації та реконструкції людського тіла.

The article is devoted to one of the highest topical issues of our time – the nature of somatic human rights and the reasons for their occurrence. Using historical and philosophical methodology, as well as a critical analysis of modern cultural, anthropological and social theories, contextualism and a sociocultural approach, the author identified the problematic field of research – the formation of somatic human rights as a result of deep cultural processes that are characteristic of the second half of the 20th – early 21st century. The article’s author insists on the thesis that the role of the state in securing human rights is secondary in comparison with the cultural processes taking place in society (with the aid of law, the state may formalize and legally fix only that issues, which have become the property of public consciousness and practice). The emergence and specificity of somatic human rights are considered in the article within hypermodern as the current state of society’s development. Taking the latest cultural and anthropological studies of Western scientists as a basis, the author proves that the body today is endowed with an exceptional status and special significance in contrast to previous eras, which were characterized by the consolidation of this status for an Individual, a Human. Our time, which can be denoted by the terms “hypermodern”, “cyborg code”, etc., is the context within which the final emancipation of a person from centuries-old religious and ideological burdens in terms of the human right to his own body took place. The author emphasizes that modern somatic rights are an open system, since they have a variable nature, which is greatly enhanced by the achievements of the fourth industrial revolution, including in terms of nano- and information technologies. It has been proved that somatic human rights as one of the types of “new” human rights are associated with the human-centered paradigm in jurisprudence. The legal consolidation of somatic rights as the right to dispose of one’s body (“self-ownership”) made possible the processes of improvement, modification and reconstruction of the human body.
