Cутність категорії «доброчесність військових посадових осіб»

Abstract

Стаття присвячена визначенню сутності доброчесності військових посадових осіб. З’ясовано, що посилення вимог до рівня правової свідомості, правової культури, законослухняності представників публічної влади є сьогодні загальносвітовою тенденцією. У більшості цивілізованих демократичних країн нині визначено низку обмежень та заборон для осіб, які здійснюють функції держави, у тому числі й для військовослужбовців. Запровадження викладення у вільний доступ декларацій осіб, уповноважених на виконання функцій держави або місцевого самоврядування, збільшення уваги до додержання правил академічної доброчесності свідчать про зростання етичних вимог до поведінки представників сектору безпеки і оборони в Україні. Необхідність реалізації означених вище положень щодо забезпечення доброчесної поведінки військових посадових осіб потребує створення адміністративно-правового механізму, за допомогою якого задекларовані нормотворцем цілі могли б втілитися у площину реальних правовідносин. Це вимагає перегляду положень актів військового законодавства, в яких знайшли відображення принципи та стандарти поведінки військових посадових осіб, особливо ті з них, які стосуються відносин з цивільним населенням, а також здійснення під час виконання своїх службових обов’язків дій, які можуть містити корупційні ризики. Доброчесність військових посадових осіб може розглядатися у декількох аспектах, кожен з яких підкреслює важливість досліджуваного феномена для вирішення завдань підвищення ефективності функціонування сектору безпеки і оборони. У правовому аспекті доброчесність військових посадових осіб уявляє собою сукупність правових приписів, якими встановлюються їх обов’язки, а також заборони та обмеження щодо їх поведінки, які супроводжують увесь період несення військової служби. В інформаційному аспекті вказаний вид доброчесності означає наявність процедур оприлюднення певних відомостей та даних про військових посадових осіб (із додержанням законодавства про захист персональних даних та вимог законодавства про державну таємницю). У морально-етичному аспекті доброчесність військових посадових осіб передбачає існування у суспільстві усталеної позиції щодо неприпустимості корупції та інших проявів недоброчесності особами, які несуть військову службу. У ціннісному аспекті досліджуваний феномен означає встановлення високих моральних якостей та ін-толерантності до корупції як цінностей суспільства, що знайшли своє відображення в етичних кодексах, кодексах честі та інших документах, які самостійно розробляються і затверджуються в окремих професійних співтовариствах. У діяльнісному аспекті доброчесність військових посадових осіб може розглядатися як комплекс дій, що складаються з двох основних категорій: а) тих, які військовослужбовець зобов’язаний реалізовувати під час несення служби; б) тих, від вчинення яких військовослужбовець має утриматися.

The article is devoted to the definition of the essence of the virtue of military officials.It was found that the tightening of requirements for the level of legal consciousness, legal culture, law-abidingness of representatives of public authorities is a global trend today. In most civilized democratic countries, a number of restrictions and prohibitions have been established for persons who perform the functions of the state, including for military personnel. The introduction of free access to declarations of persons authorized to perform the functions of the state or local self-government, an increase in attention to the observance of the rules of academic virtue indicate an increase in ethical requirements for the behavior of representatives of the security and defense sector in Ukraine.The need to implement the above provisions to ensure the good behavior of military officials requires the creation of an administrative and legal mechanism, with the help of which the goals declared by the rule-maker could be translated into the plane of real legal relations. This requires a revision of theprovisions of acts of military legislation, which reflectthe principles and standards of conduct of militaryofficials, especially those related to relations with thecivilian population, as well as the implementation ofactions in the performance of their duties that maycontain corruption risks.The virtue of military officials can be consideredin several aspects, each of which emphasizes theimportance of the phenomenon under study forsolving the problems of improving the effectivenessof the functioning of the security and defense sector.In the legal aspect, the virtue of military officials is aset of legal prescriptions that establish their duties,as well as prohibitions and restrictions on theirbehavior that accompany the entire period of militaryservice. In the information aspect, this type of virtuemeans the existence of a procedure for disclosingcertain information and data about military officials(in compliance with the legislation on the protectionof personal data and the requirements of thelegislation on state secrets). In the moral and ethicalaspect, the virtue of military officials presupposesthe existence in society of an established positionregarding the inadmissibility of corruption and othermanifestations of impiety by persons in militaryservice. In the value aspect, the phenomenonunder study means the establishment of high moralqualities and intolerance to corruption as valuesof society, which are reflected in ethical codes,codes of honor and other documents independentlydeveloped and approved in individual professionalcommunities. In the activity aspect, the virtue ofmilitary officials can be viewed as a complex ofactions, consisting of two main categories: a) thosethat a soldier is obliged to implement while serving;b) those from which the soldier must refrain.
