Щодо класифікації соціальних гарантій нотаріусів у сфері освіти та професійного навчання

Abstract

У статті здійснено розгляд основних нормативно-правових актів, які визначають необхідність здійснення професійного навчання та підвищення рівня кваліфікації нотаріусів. Наголошено та тому, що це є не право, а обов’язок нотаріуса, а отже з боку держави мають бути створені всі умови для реалізації вказаного права. Запропоновано гарантії нотаріусів у сфері освіти, професійного навчання та підвищення кваліфікації поділити на три основні групи: 1) загальні гарантії: а) власне право на освіту, професійне навчання, підвищення кваліфікації; б) наявність сучасних засобів та технологій навчання нотаріусів; в) можливість користування різноманітними інформаційними ресурсами та ресурсами, які містяться у бібліотеках; г) безоплатне забезпечення підручниками, навчальними посібниками, іншими інформаційними ресурсами на період навчання та можливості їх подальшого придбання для безпосередньої роботи (за бажанням нотаріуса) тощо. 2) спеціальні гарантії: а) обслуговування у закладах освіти з метою навчання та підвищення своєї кваліфікації; б) реалізація передбачених нормативно-правовими актами форм підвищення нотаріусами свого професійного рівня кваліфікації; в) гарантія участі у позапланових та додаткових заходах з підвищення кваліфікації; г) гарантії, які застосовується до нотаріусів, які тільки розпочинають свою нотаріальну діяльність; д) гарантування отримання відповідного документу про проходження навчання нотаріусом; е) вибір нотаріусом виду підвищення кваліфікації; є) гарантія комплексно-го навчання чи підвищення кваліфікації нотаріуса; ж) вибір нотаріусом форми участі у процесі навчання чи підвищення рівня кваліфікації. 3) гарантії, які не пов’язані із безпосереднім процесом освіти та навчання: гарантія збереження робочого місця за нотаріусом на період проходження навчання. Наголошено на проблемі відсутності гарантії звільнення від обов’язку підвищення кваліфікації нотаріусом в окремих випадках, до яких вченим запропоновано віднести тривалу тимчасову непрацездатність нотаріуса, що, фактично позбавляє нотаріуса здійснити підвищення своєї кваліфікації у зв’язку зі станом здоров’я. Вченим наголошено на важливості оновлення законодавства у сфері освіти та професійного навчання нотаріусів із врахуванням не тільки всіх аспектів нотаріальної діяльності, а й сучасних технологій у сфері навчання та підвищення кваліфікації.

The article considers the main regulations that determine the need for professional training and advanced training of notaries. It was also emphasized that this is not a right, but a duty of a notary, and therefore the state must create all the conditions for the exercise of this right. It is proposed to divide the guarantees of notaries in the field of education, vocational training and advanced training into three main groups: 1) general guarantees: a) own right to education, vocational training, advanced training; b) the availability of modern tools and technologies for training notaries; c) the ability to use a variety of information resources and resources contained in libraries; d) free provision of textbooks, manuals, other information resources for the period of study and the possibility of their further acquisition for direct work (at the request of a notary), etc. 2) special guarantees: a) service in educational institutions for the purpose of training and advanced training; b) implementation of the forms of raising the professional qualification of notaries provided by normative legal acts; c) guarantee of participation in unscheduled and additional training activities; d) guarantees applicable to notaries who are just beginning their notarial activities; e) guaranteeing the receipt of the relevant document on the training of a notary; f) choice by the notary of the type of advanced training; g) a guarantee of comprehensive training or advanced training of a notary; g) choice by the notary of the form of participation in the process of training or advanced training. 3) guarantees that are not related to the direct process of education and training: a guarantee of preservation of the job by a notary for the period of training. The problem of lack of guarantee of exemption from the obligation to improve the skills of a notary in some cases, which scientists have proposed to include long-term temporary incapacity of the notary, which effectively deprives the notary to improve their skills due to health. Scientists stressed the importance of updating the legislation in the field of education and vocational training of notaries, taking into account not only all aspects of notarial activities, but also modern technologies in the field of education and training.
