Місце міжнародного парламентського союзу в процесі еволюціонування парламентаризму

Abstract

У статті досліджується становлення інституту парламентаризму в світі, встановлюються фактори, які впливали на процес еволюціонування. Наводяться приклади законодавчих органів різних країн, порівнюється їх структура, проаналізовані нормативні правові акти, які впливали на розвиток та становлення парламентаризму. В статті доказується важливість парламенту в процесі функціонування держави враховуючи історичний аспект та майбутня перспектива і напрям діяльності інституту, з огляду на прийняття рішень даного інституту залежить правова система цілої країни, а іноді зовнішньополітичний курс. Цей орган чітко слідкує нормам основного закону держави, та є гарантом прав та свобод людини. Парламент – це вищий законодавчий та представницький орган в державах, він налічує представників, які були обрані від всього населення та всіх регіонів. У сучасний час парламент є законодавчим органом, тобто наділений повноваженнями приймати закони, а також формувати та контролювати виконавчу владу та налагоджувати міжпарламентське співробітництво. В даній науковій праці з’ясовується місце і роль міжнародних організацій в процесі еволюціонування інституту парламентаризму через призму діяльності міжнародного парламентського союзу, аналізується його нормативно-правова база, розглядається структура організації. Опрацьовуються основні напрями діяльності союзу, результат нормотворчої діяльності організації у вигляді прийнятих резолюції. В статті досліджуються основні декларації міжнародного парламентського союзу, а саме декларація про критерії вільних і справедливих виборів та загальну декларацію про демократію [2]. Розкривається генезис союзу, враховуючи історичну складову, чинники, які впливали та окреслюється майбутня перспектива за допомогою подальшого парламентського діалогу на базі унікального форуму. Створений багатосторонній парламентський діалог проектує досвід та погляд на вирішення кризових ситуації, опрацьовує нові шляхи вирішення та запобігання конфліктів. На базі міжнародного парламентського союзу створена велика програма сприянню демократії і сама організація є потужним та ефективним джерелом для парламентів.

The article examines the formation of the institution of parliamentarism in the world, establishes the factors that influenced the process of evolution. Examples of legislative bodies of different countries are given, their structure is compared, normative legal acts that influenced the development and establishment of parliamentarism are analyzed. The article confirms the importance of the parliament in the process of functioning of the state, taking into account the historical aspect and the future perspective and direction of the institute’s activity, considering the decision-making of this institute depends on the legal system of the entire country, and sometimes the foreign policy course. This body clearly follows the norms of the basic law of the state, and is the guarantor of human rights and freedoms. Parliament is the highest legislative and representative body in the states, it includes representatives who are elected from the entire population and all regions. In modern times, the parliament is a legislative body, that is, it is empowered to pass laws, as well as to form and control the executive power and establish inter-parliamentary cooperation. This scientific work clarifies the place and role of international organizations in the process of evolution of the institution of parliamentarism through the prism of the activities of the international parliamentary union, analyzes its legal framework, and considers the structure of the organization. The main directions of the Union’s activity, the result of rule-making activities in the organization of adopted resolutions, are being worked out. The article examines the main declarations of the International Parliamentary Union, namely the Declaration on the Criteria of Free and Fair Voters and the General Declaration on Democracy. The genesis of the union is revealed, taking into account the historical component, influencing factors, and the future perspective is outlined with the help of further parliamentary dialogue on the basis of a unique forum. The created multilateral parliamentary dialogue projects the experience and perspective on the solution of the crisis situation, develops new ways of resolving and preventing conflicts. On the basis of the International Parliamentary Union, a large program for the promotion of democracy has been created, and the organization itself is a powerful and effective source for parliaments.
