Особливості трасологічного дослідження динамічних слідів знарядь зламу

Abstract

Аналіз правозастосовчої практики показав, що нині значна частина злочинів супроводжується зламом перешкод, замикаючих механізмів, вчинених із застосуванням різноманітних знарядь і предметів, а для розкриття даних злочинів судовим експертам потрібні спеціальні знання. Питання теоретичної недосконалості в судово-трасологічному дослідженні слідів знарядь зламу та потреба у подальшому розвитку методичних підстав трасологічного дослідження динамічних слідів знарядь зламу визначили актуальність цієї статті. У роботі розглянуто низку питань, що стосуються правильної оцінки результатів дослідження, проведеного за динамічними слідами знарядь зламу на основі практичної діяльності експертів-криміналістів. Також розглянуто деякі особливості проведення експертизи слідів знарядь зламу під час проведення етапу експертного експерименту та етапу порівняльного дослідження на стадії детального дослідження, з подальшою оцінкою можливості ідентифікації знарядь зламу виходячи з даних особливостей. Вказано, що за результатами дослідження з’являється можливість встановлення найважливіших фактів для розслідування злочину, а саме:– чи мала місце подія злочину (чи виникли сліди внаслідок протиправних дій чи походження їх випадково);– групової приналежності знаряддя зламу слідам зламу, що сприяє зменшенню області об’єктів, що перевіряються, і розшуку шуканого об’єкта;– деяких ознак особи зломщика, що допомагає звузити коло осіб, серед яких слід проводити оперативні заходи щодо розшуку та встановлення злочинця, а також способу та обставин зламу та конкретну ідентифікацію інструменту, яким утворено слід. З урахуванням розглянутих особливостей, експерти-криміналісти при проведенні судових трасологічних експертиз за динамічними слідами знарядь зламу, мають можливість значно підвищити якість та достовірність досліджень.

The analysis of law enforcement practice showed that nowadays a significant part of crimes is accompanied by the breaking of obstacles, locking mechanisms, committed with the use of various tools and objects, and forensic experts need special knowledge to solve these crimes. The issue of theoretical imperfection in the forensic traceological study of traces of hacking tools and the need for further development of methodological foundations of the traceological research of dynamic traces of hacking tools determined the relevance of this article.The work deals with a number of issues related to the correct assessment of the results of the research conducted on the dynamic traces of burglary tools based on the practical activities of forensic experts. Also considered are some features of the examination of traces of hacking tools during the expert experiment stage and the stage of comparative research at the stage of detailed research, with a further assessment of the possibility of identifying hacking tools based on these features.It is indicated that the results of the study make it possible to establish the most important facts for the investigation of the crime, namely:– whether a crime took place (whether traces appeared as a result of illegal actions or their origin by chance);– the group belonging of the burglary tool to the traces of burglary, which helps to reduce the area of objects to be checked and to search for the wanted object; – some signs of the identity of the burglar, which helps to narrow down the circle of persons among whom operational measures should be taken to search for and identify the criminal, as well as the method and circumstances of the burglary and the specific identification of the tool that formed the trace.Taking into account the considered features, forensic experts, when conducting forensic trasological examinations on dynamic traces of hacking tools, have the opportunity to significantly increase the quality and reliability of research.
