Правові засади мовної політики України в умовах воєнного стану

Abstract

Статтю присвячено мовній політиці нашої держави та її правовим основам – одній із найбільш дискусійних проблем українського суспільства, яка значно актуалізувалася нині. У статті розглянуто питання функціонування української мови як державної в умовах воєнного стану внаслідок військової агресії з боку Російської Федерації. У зв’язку з цим окреслення правових засад функціонування української мови, а також системний аналіз означеного питання набуває актуального значення. У статті визначено, що мовне законодавство є складовою частиною мовної політики будь-якої держави, проаналізовано українське законодавство, яке регламентує функціонування державної та інших мов у країні, його вплив на мовну ситуацію, подано перелік законодавчих актів, котрі утворюють чинне мовне законодавство України. З урахуванням того, що гострота мовного питання є результатом довготривалого процесу утисків української мови, наголошено на чинниках, які вплинули на мовну ситуацію, яка складалася в Україні впродовж тривалого періоду, та окреслено наслідки ігнорування вимог законодавства щодо обов’язкового застосування державної мови з боку посадових осіб органів державної влади різних рівнів або органів місцевого самоврядування. Зазначено особливості сприйняття на сучасному етапі невиконання вимог мовного законодавства громадянським суспільством та окремими громадянами України, котрі усвідомлюють значення української мови для майбутнього нашої держави. Зроблено висновки про нинішню мовну ситуацію в Україні, котра сприяє забезпеченню повноцінного функціонування української мови як державної, оскільки наявна низка чинників, яка забезпечує означені процеси, як-от: мовне законодавство, суспільні запити, пов’язані з національним піднесенням внаслідок протистояння агресії Російської Федерації, зростання патріотизму, небажання використовувати російськомовний контент тощо.

The article is devoted to the language policy of our state and its legal foundations – one of the most debatable problems of Ukrainian society, which has been significantly updated today. The article examines the functioning of the Ukrainian language as a state language in the conditions of martial law as a result of military aggression by the Russian Federation. In this regard, the delineation of the legal basis of the functioning of the Ukrainian language, as well as the systematic analysis of the specified issue, acquires urgent importance. The article defines that language legislation is an integral part of the language policy of any state, analyzes the Ukrainian legislation that regulates the functioning of the state and other languages in the country, its impact on the language situation, provides a list of legislative acts that form the current language legislation of Ukraine. Taking into account the fact that the acuteness of the language issue is the result of a long-term process of suppression of the Ukrainian language, the factors that influenced the language situation in Ukraine over a long period are emphasized, and the consequences of ignoring the requirements of the legislation regarding the mandatory use of the state language by officials are outlined persons of various levels of state authorities or local self-government bodies. Peculiarities of perception at the current stage of non-fulfillment of the requirements of language legislation by civil society and individual citizens of Ukraine, who are aware of the importance of the Ukrainian language for the future of our state, are noted. Conclusions have been made about the current language situation in Ukraine, which contributes to ensuring the full functioning of the Ukrainian language as a state language, since there are a number of factors that ensure the specified processes, such as: language legislation, public requests related to national elevation as a result of resisting the aggression of the Russian Federation, growth patriotism, reluctance to use Russian-language content, etc.
