Правовий захист конституційних принципів у рішеннях Конституційного Суду Угорщини

Abstract

Стаття присвячена аналізу правових позицій Конституційного Суду Угорщини щодо захисту фундаментальних конституційних принципів цієї держави, зокрема верховенства права (таких його складових, як правова визначеність, поділ влади), суверенітету держави, відокремлення церкви від держави, демократії тощо. З цією метою для аналізу відібрані такі рішення Конституційного Суду Угорщини, які найбільш повно дають змогу виявити його правові позиції у відповідних аспектах. Зроблено висновки щодо еволюції Конституційного Суду на шляху утвердження місії основного органу захисту Консти- туції, її основних принципів. При цьому найважливішою віхою на цьому шляху стало набрання чинності Основним Законом 2011 р. (з 1 січня 2012 р.). Більша частина рішень Конституційного Суду Угорщини в цьому питанні стосувалася змісту і ролі фундаментальних конституційних принципів, зокрема в аспекті взаємостосунків національного правопорядку та правопоряд- ку Європейського Союзу.

The article is devoted to the analysis of the legal positions of the Constitutional Court of Hungary regarding the protection of the fundamental constitutional principles of this state, in particular the rule of law (such as its components of legal certainty, separation of powers), sovereignty of the state, separation of the church from the state, democracy, etc. To this end, the decisions of the Constitutional Court of Hungary have been selected for analysis, which most fully enable it to express its legal position in the relevant aspects. Conclusions have been drawn on the evolution of the Constitutional Court on the path to the approval of the mission of the main body of protection of the Constitution, its basic principles. The most important milestone along the way was the entry into force of the Basic Law of 2011 (from January 1, 2012). Much of the decisions of the Constitutional Court of Hungary in this matter concerned the content and role of fundamental constitutional principles, in particular in the context of the relationship between national law and order of the European Union.
