Комунікативно-прагматичні особливості перекладу юридичних документів

Abstract

У статті досліджено комунікативно-прагматичні аспекти перекладу офіційних юридичних документів Ради Європи. Основними стилістичними рисами документів є логічність, об’єктивність, ясність, чіткість, конкретність, безособовість, узагальненість, строгість. Виявлено, що вони пов’язані з основними комунікативно-прагматичними функціями мови офіційно-ділового стилю: інформативною, конкретизуючою та зобов’язуючою. З’ясовано, що для вираження зобов’язання використовуються мовні одиниці волевиявлення – спонукальна форма, імператив / індикатив з імпліцитним значенням імператива. Доведено, що в офіційних англійських документах Ради Європи перевага надається модальним дієсловам при виконанні цієї функції. Модальні дієслова мають деякі особливості, що виникають не лише в зв’язку з їх традиційним використанням в певних жанрах документів, але й в силу тих семантичних аспектів документів, які ці дієслова в них набувають. Встановлено, що є ряд слів, які мають приблизно однакове комунікативно-прагматичне наповнення зі значенням зобов’язання та схвалення/несхвалення, які ми поділяємо на такі групи: комунікативно-прагматичний відтінок схвалення, згоди; комунікативно-прагматичний відтінок прохання, наказу; комунікативно-прагматичний відтінок несхвалення; нейтральний комунікативно-прагматичний відтінок. Виявлено, що основною комунікативно-прагматичною функцією офіційних документів РЄ є регламентаційно-директивна. Уточнено, що за характером комунікативної інтенції тексти документів міжнародного права поділяються на: комісивні договірні тексти, які є колективними мовленнєвими актами прийняття сторонами взаємних зобов’язань; комісивні договірні тексти, які є кооперативними мовленнєвими актами прийняття зобов’язань; декларативні тексти при участі двох та більше держав; декларативні тексти за участю однієї держави, що є одиничними мовленнєвими актами, а також тексти інших міжнародних правових документів.

The article deals with the communicative and pragmatic aspects of the translation of official legal documents of the Council of Europe. The main stylistic features of the documents are logicality, objectivity, clarity, precision, specificity, impersonality, generality, and rigour. It has been found that they are related to the main communicative and pragmatic functions of the language of official business style: informative, specifying, and obligatory. It has been found that the linguistic units of expression of will are used to express obligation - the imperative form, the imperative/indicative with the implicit meaning of the imperative. It is proved that in the official English documents of the Council of Europe, preference is given to modal verbs in performing this function. Modal verbs have some peculiarities arising not only from their traditional use in certain genres of documents but also from the semantic aspects of documents that these verbs acquire. It is established that there are a number of words that have approximately the same communicative and pragmatic content with the meaning of obligation and approval/disapproval, which we divide into the following groups: communicative and pragmatic connotation of approval, consent; communicative and pragmatic connotation of request, order; communicative and pragmatic connotation of disapproval; neutral communicative and pragmatic connotation. It is found that the main communicative and pragmatic function of the official documents of the Council of Europe is regulatory and directive. The authors clarify that, according to the nature of the communicative intent, the texts of international law documents are divided into: commission treaty texts which are collective speech acts of the parties' assumption of mutual obligations; commission treaty texts which are cooperative speech acts of assumption of obligations; declaratory texts with the participation of two or more states; declaratory texts with the participation of one state which are single speech acts, as well as texts of other international legal documents.
