Інституційне та функціонально-правове забезпечення екологічної функції держави

Abstract

Стаття присвячена інституційному та функціонально-правовому забезпеченню екологічної функції держави крізь призму дослідження дефініцій «функція держави» та «екологічна функція держави» на основі аналізу думок провідних науковців. Потрібно розуміти, що погіршення екологічної ситуації в Україні викликане не лише війною, але і господарською діяльністю людини, і воно вийшло за межі окремих територій, поширюючись в глобальному масштабі. Однією з ключових проблем, яка потребує вирішення, є формування розуміння ролі та місця стану екологічної функції держави. Держава має визнати, що охорона навколишнього середовища є надзвичайно важливою для сталого розвитку країни, і повинна розробити принципово нове ставлення до цієї проблеми.Вказується, що виокремлення екологічної функції є неодмінною умовою аналізу діяльності держави при умові чіткого розуміння зв’язків екологічної політики держави та дійсного екологічного стану в країні. Визначено, що екологічна функ-ція держави – це сукупність заходів, які держава приймає для забезпечення екологічної безпеки та збереження природних ресурсів для майбутніх поколінь. Основна мета екологічної функції держави - це збереження природних ресурсів, забезпечення екологічної безпеки, запобігання екологічним катастрофам, забрудненню навколишнього середовища та знищення біорізноманіття. Завдання екологічної функції держави включає наступне: прийняття законів, що регулюють використання природних ресурсів та забруднення довкілля; розробка та впровадження програм охорони природи, збереження біорізноманіття та зменшення викидів в атмосферу; забезпечення контролю за додержанням норм та стандартів екологічної безпеки; проведення наукових досліджень та моніторингу стану навколишнього середовища; впровадження економічних механізмів, які стимулюють збереження природних ресурсів та екологічні інвестиції; підвищення екологічної свідомості населення та сприяння розвитку екологічного виховання.

The article deals with institutional, functional and legal provision of ecological function of the state through the prism of the definitions – “state function” and “ecological function of the state” – studying. It was based on the analysis of the leading scientists’ opinions. It is necessary to understand that the deterioration of the ecological situation in Ukraine is caused not only by the war, but also by human economic activity, and it has gone beyond the boundaries of individual territories, spreading on a global scale. One of the key problems that needs to be solved is the formation of the role and place of the state’s ecological function understanding. The state must recognize the extreme importance of environmental protection for the sustainable development of the country; must develop a fundamentally new attitude to this problem.It is indicated that the separation of the ecological function is an indispensable condition for the analysis of the state’s activities, provided that there is a clear understanding of the connections between the state’s environmental policy and the actual ecological situation in the country. It was determined that the ecological function of the state is a set of measures that it takes to ensure environmental safety and preserve natural resources for future generations. The main goal of the ecological function of the state is to preserve natural resources, ensure environmental safety, prevent environmental disasters, environmental pollution, and the destruction of biodiversity. The task of the ecological function of the state includes the following: adoption of laws regulating the natural resources’ usage and environmental pollution; development and implementation of programs for nature protection, preservation of biodiversity and reduction of emissions into the atmosphere; ensuring control over compliance with environmental safety norms and standards; conducting scientific research and monitoring the state of the environment; implementation of economic mechanisms that stimulate conservation of natural resources and environmental investments; increasing the environmental awareness of the population and promoting the development of environmental education.
