До проблеми соціального захисту сімей з дітьми

Abstract

Стаття присвячена дослідженню особливостей правового регулювання соціального захисту сімей з дітьми, аналізу проблемних питань в цій сфері та запропоновано шляхи вдосконалення соціальної підтримки з урахуванням суспільних змін. Зазначено, що першочерговим завданням нашої держави є вирішення складної демографічної ситуації щодо покращення народжуваності і створення соціально-економічних передумов для народження у сім’ї двох і більше дітей. Було визначено види соціального захисту і підтримки сімей дітьми. Досліджено особливості надання державної соціальної допомоги як складового елементу системи соціального захисту населення України. На основі проведеного дослі-дження було виявлено, що чинне соціально-захисне законодавство потребує вдосконалення щодо упорядкування соціальних виплат і пільг. Так, законодавець оперує різними показниками соціальних стандартів та нормативів при призначенні соціальних допомог і послуг використовуючи: прожитковий мінімум для дітей відповідного віку; прожитковий мінімум для осіб, які втратили працездатність; рівень забезпечення прожитко-вого мінімуму; неоподаткований мінімум доходів громадян, мінімальну заробітну плату. Це говорить про те, що доволі часто при призначенні соціальних виплат не забезпечується виконання положень ст. 46 і 48 Конституції України щодо достатнього життєвого рівня для себе і своєї сім’ї.Розглянуто характеристики сімейної політики в деяких розвинутих країнах світу та соціальний захист дитячих сімей в контексті запозичення позитивного досвіду для України. Обґрунтовано потребу вдосконалення законодавчої нормативно-правової бази у сфері соціального забезпечення сімей з дітьми. Внесено конкретні пропозиції щодо вдосконалення законодавства. Запропоновано при призначенні соціальних виплат враховувати загальний рівень середньої заробітної плати, ріст цін і рівень інфляції та використовувати фактичні показників прожиткових мінімумів, як для дитини, так і для батьків.

The article is devoted to the study of the peculiarities of legal regulation of social protection of families with children, analysis of problematic issues in this field. The ways of improving of social support in view of social changes are proposed as well. It is noted that the primary task of our state is to resolve the difficult demographic situation to improve the birth rate and create socio-economic prerequisites for the birth of two or more children in a family.The types of social protection and support for families with children are identified. The features of providing state social assistance as a component of the social protection system of Ukraine are investigated. Based on the study, it was found that the current social protection legislation needs to be improved in terms of streamlining social benefits and privileges. Thus, the legislator operates with different indicators of social standards and norms when assigning social benefits and services, using: the subsistence minimum for children of the appropriate age; the subsistence minimum for persons who have lost their ability to work; the level of ensuring the subsistence minimum; the tax-free minimum income of citizens, the minimum wage. This suggests that quite often, when social benefits are granted, the provisions of Articles 46 and 48 of the Constitution of Ukraine regarding an adequate standard of living for oneself and one’s family are not ensured.The characteristics of family policy in some developed countries and social protection of children’s families in the context of borrowing positive experience for Ukraine are considered. The need to improve the legislative regulatory framework in the field of social security of families with children has been substantiated. Specific proposals have been made to improve the legislation. It has been proposed to take into account the overall level of the average salary, price growth and inflation when assigning social payments. Subsistence level indicator should be used for the child and for the parents as well.
