Система та структура державного управління

Abstract

У статті на підставі чинного національного законодавства розглянуто систему та структуру державного управління. Предметом дослідження є адміністративно-правові норми, що регламентують форми та методи управлінської діяльності, особливості управлінської практики, а також базові положення науки адміністративного права у відповідній сфері. Метою статті є аналіз сучасного стану форм і методів управлінської діяльності органів державної влади. Формуванню уявлення про розвиток управлінської діяльності сприяє використання діалектичного методу, в основі якого лежить аналіз традиційних форм і методів управлінських дій, а також зіставлення з формами та методами, що з’являються завдяки розвитку інформаційно-комунікаційних технологій, цифровізації, клієнто-орієнтованого підходу. Зазначено, що уніфікована типологія інших органів у структурі державної влади України побудована з урахуванням єдності та різноманіття функцій, обсягу компетенції та основних форм управлінських процесів у контексті адміністративної процедури. Вказано, що сутність цієї типології полягає у формуванні несуперечливої системи органів, до якої, крім органів виконавчої влади, традиційно представлених на центральному та місцевому рівні (міністерства, служби, агентства), входять інші органи, які здійснюють спеціальні функції. Реформування систем державних органів з урахуванням зазначеної типології забезпечить реалізацію принципу єдності системи публічної влади та усуне наявні у межах таких систем протиріччя. Правове регулювання відносин у сфері управління побудовано на предметно-логічних зв’язках базових структурних елементів управлінської діяльності, визначає систему впливу суб’єкта державного управління у межах своєї компетенції на керований об’єкт, його стан та поведінку під час здійснення суб’єктом державного управління конкретних управлінських дій у певній формі, спрямованих на досягнення мети державного управління. У подальших дослідженнях слід охопити вплив інформаційно-комунікаційних технологій на систему та структуру державного управління.

The article examines the system and structure of public administration based on current national legislation. The research subject is the administrative and legal norms regulating the forms and methods of management activity, the peculiarities of management practice, and the introductory provisions of the science of administrative law in the relevant field. The purpose of the article is to analyze the current state of the forms and methods of management of state authorities. The use of the dialectical method, which is based on the analysis of traditional forms and methods of managerial actions, as well as comparison with the conditions and procedures that appear due to the development of information and communication technologies, digitalization, and a client-oriented approach, contributes to the formation of an idea about the product of management activities. It noted that the unified typology of other bodies in the structure of the state power of Ukraine took into account the unity and diversity of the implemented functions, the scope of competence and the primary forms of management processes used in the context of the administrative procedure. The essence of this typology consists in the formation of a consistent system of bodies, which, in addition to the bodies of executive power, traditionally represented at the central and local level (ministries, services, agencies), includes other bodies that perform particular functions. Reforming the systems of state bodies considering the specified typology will ensure the implementation of the principle of unity of the system of public power and eliminate existing contradictions within such systems. The legal regulation of relations in the field of management is built on the subject-logical connections of the essential structural elements of management activity, determines the method of influence of the subject of state management within its competence on the managed object, its condition and behavior when the subject of state management carries out specific managerial actions in a particular form, aimed at achieving the goal of public administration. Further research should cover the impact of information and communication technologies on the system and structure of public administration.
