Сучасний стан технічного забезпечення електронного правосуддя в Україні

Abstract

В статті зазначено, що система електронного судочинства (правосуддя) складається з елементів, які умовно слід поділити на три групи: 1) ті, що забезпечують взаємодію суду та учасників судового процесу (електронний суд), тобто спрямовані безпосередньо на здійснення судочинства та пов’язаних із ним процесів (подання позовної заяви, апеляційної, касаційної скарг в електронній формі, відстеження ходу розгляду справи у мережі Інтернет, направлення судових повісток, повідомлень засобами електронного зв’язку, участь у розгляді справи в режимі відеоконференції, доступ до судових рішень в Єдиному державному реєстрі судових рішень тощо); 2) ті, що забезпечують взаємодію судів між собою, а також суду з іншими органами публічного управління (система електронного документообігу, доступ до державних реєстрів, отримання та перевірка дійсності електронних доказів тощо); 3) ті, що забезпечують організацію внутрішніх управлінських процесів (електронна система управління кадрами, електронна система судової статистики, електронні архіви, електронна бібліотека суду тощо)Крім того, встановлено, що електронне правосуддя, як основа інформатизації судової системи, наразі не лише забезпечує ефективний механізм реалізації захисту своїх прав громадянами, а є й відповідним ключем до розвитку інформаційного суспільства. Саме його інструменти дозволяють зробити певні процесуальні та судові дії віртуальними завдяки використанню інформаційно-телекомунікаційних технологій. При цьому найбільш успішним результатом електронного правосуддя в Україні, на нашу думку, є забезпечення доступу до судових рішень в електронному вигляді.Зроблено висновок, що теперішня ситуація, коли майже всі зали судових засідань в більшості судах України обладнані сучасною технікою, яка дозволяє не лише вести аудіозапис засідання, а й провести його в онлайн режимі чи просто оперативно та повноцінно підготувати судове рішення в електронному вигляді або ж надати всю необхідну інформацію сторонам процесу, є новим відповідальним етапом розвитку правосуддя. Крім того, великої цінності дані можливості набувають в умовах воєнного стану та у зв’язку із загостренням проблеми кадрового забезпечення судів. Адже на разі, на жаль, юрисдикцію багатьох судів, що розташовані на тимчасово окупованих територіях, необхідно передавати іншим судам, і майже кожного дня Вища рада правосуддя звільняє суддів у зв’язку з їх заявами про відставку, що призводить до збільшення навантаження.

The article states that the system of electronic justice (justice) consists of elements that should be conventionally divided into three groups: 1) those that ensure the interaction of the court and participants in the judicial process (electronic court), that is, aimed directly at the implementation of justice and related processes with him (submitting a statement of claim, appeal, cassation complaint in electronic form, tracking the progress of the case on the Internet, sending court summonses, notifications by means of electronic communication, participating in the consideration of the case via video conference, access to court decisions in the Unified State register of court decisions, etc.); 2) those that ensure the interaction of courts with each other, as well as courts with other public administration bodies (electronic document circulation system, access to state registers, obtaining and verifying the validity of electronic evidence, etc.); 3) those that ensure the organization of internal management processes (electronic personnel management system, electronic court statistics system, electronic archives, electronic court library, etc.)In addition, it was established that electronic justice, as the basis of the informatization of the judicial system, currently not only provides an effective mechanism for citizens to protect their rights, but is also a key to the development of the information society. Its tools make it possible to make certain procedural and judicial actions virtual thanks to the use of information and telecommunication technologies. At the same time, the most successful result of electronic justice in Ukraine is providing access to court decisions in electronic form.It was concluded that the current situation, when almost all courtrooms in most courts of Ukraine are equipped with modern technology, which allows not only to conduct an audio recording of the meeting, but also to conduct it online or simply quickly and fully prepare a court decision in electronic form or provide all the necessary information to the parties to the process, is a new responsible stage in the development of justice. In addition, these opportunities become of great value in the conditions of martial law and in connection with the aggravation of the problem of court staffing. At the moment, unfortunately, the jurisdiction of many courts located in the temporarily occupied territories must be transferred to other courts, and almost every day the Supreme Council of Justice dismisses judges in connection with their resignations, which leads to an increase in the workload.
