Сучасні детермінанти та форми міжнародних торговельних суперечок

Abstract

Визначено суть, місце і функції міжнародних торговельних суперечок у процесі формування міждержавних торговельних процесів. Досліджено суб’єктно-об’єктну характеристику конфронтації в міжнародній торгівлі, з’ясовано причини, форми, чинники впливу, світові тенденції, обґрунтовано теоретичні основи виникнення торговельних суперечок та їх можливе подальше поглиблення у стадію конфлікту чи війни. Розкрито категорії «торговельна суперечка», «торговельний конфлікт» та «торговельна війна», дано їх комплексну характеристику, що допомагає більш детально виявити основопричини виникнення конфронтацій між країнами та стадії їх розгорнення. Проаналізовано перелік торговельних суперечок у рамках Світової організації торгівлі в період із 1995 по 2019 р. Визначено найактивніші країни в проведенні та ініціюванні торговельних суперечок, до них входять США, ЄС, Канада як позивачі та США, ЄС, Китай як відповідачі.

The essence, place and functions of international trade disputes in the process of formation of interstate trade processes are determined. The subject-object characterization of the confrontation in international trade is investigated, the causes, forms, factors of influence, world tendencies are found out, the theoretical bases of the emergence of trade disputes are grounded and their possible further deepening into the stage of conflict or war, improves the interpretation of the concepts of «trade dispute», «trade conflict» and «trade war», their complex characterization helps to reveal in more detail the main causes of confrontations between countries and the stage of their aggravation. The typing and refinement of the determinants of international trade conflicts has been systematized and improved, and listed and characterized. The determinants include: the motive of the country causing the dispute, the extent, causes, subjects, duration, methods of settlement, the degree of aggravation of the situation and the consequences. The list of trade disputes within the World Trade Organization in the period from 1995 to the present time of 2019 is analyzed. The most active countries in conducting and initiating trade disputes have been identified, including the USA, the EU, Kanаda as the plaintiff and the USA, the EU and China as the defendant. The authors indicated causes of trade contradictions in the sectoral section: gasoline and oil products, metal products and certain types of hot-rolled steel products, semiconductors and certain types of computer equipment, fresh and frozen meat, meat, fish, shrimp and other seafood and coffee products, alcoholic beverages, textiles, clothing, footwear, pharmaceuticals and agrochemicals; in the services market: copyright and intellectual property infringement. It has been theoretically argued that the effects of trade disputes can be extremely serious and are likely to cause worsening in the well-being of people around the world and worsen the outlook for global economic growth. A systematic study of the processes of the international trade conflict is important and timely from both theoretical and practical points of view, which determined the topic of the work and its purpose.
