Ознаки та види актів «м’якого права»

Abstract

Стаття присвячена виділенню ознак актів «м’якого права», які дозволяють вирізнити їх серед інших джерел права, а також систематизації різних видів актів «м’якого права». Проаналізовано, які ознаки правової норми притаманні нормам, що містяться в актах «м’якого права». Виділено основні форми, в яких можна зустріти акти «м’якого права» в ієрархії джерел права. Ключові слова: акти «м’якого права», норми актів «м’якого права», ознаки норм права, ознаки актів «м’якого права», види актів «м’якого права».

The article is dedicated to highlighting of the features of the acts of «soft law», which can single them out from other sources of law, and also to systematization of the different types of acts of «soft law». The features of the rule of law which are typical for the norms being contained in the acts of «soft law» are analyzed. The main forms in which acts of «soft law» can be found in the hierarchy of the sources of law are defined.
