Взаємодія політичної влади та громадянського суспільства: теоретико-правовий аспект

Abstract

Статтю присвячено аналізу теоретико-правового аспекту взаємодії політичної влади та громадянського суспільства. З’ясовано, що взаємодія політичної влади і громадянського суспільства постійно набуває політичної гостроти та актуальності, адже влада не може ефективно функціонувати без взаєморозуміння і конструктивної взаємодії з громадянським суспільством. Визначено праворегулюючі функції у відносинах політичної влади та громадянського суспільства. З’ясовано, що наразі в Україні процеси як становлення демократичної правової держави, так і інституціоналізації громадянського суспільства відбуваються практично одночасно, взаємодоповнюючи один одного. Взаємодія політичної влади та громадянського суспільства складається із двох взаємно відповідальних впливів – держави на громадянське суспільство та громадянського суспільства – на державу. Проаналізовано наукові погляди щодо специфіки та актуальності взаємодії політичної влади та інститутів громадянського суспільства. Констатовано, що відносини політичної влади та громадянського суспільства можуть бути збалансованими лише за умови «зрілості» громадянського суспільства. Політична ж актив-ність громадськості – ознака розвинутого громадянського суспільства, і, відповідно, підґрунтя демократії. Теоретично обґрунтовано, що до основних принципів взаємодії політичної влади та громадянського суспільства належать соціальне партнерство, забезпечення рівних можливостей, взаємовідповідальність, відкритість та прозорість, невтручання, визнання органами державної влади різних видів діяльності громадських об’єднань, підвищення ефективності процесу взаємодії. Проаналізовано концепцію «енергійне громадянське суспільство завжди послаблює, а не підсилює демократію». Виокремлено основні причини, які перешкоджають належній взаємодії політичної влади з громадськістю. Обґрунтовано, що саме ефективність взаємодії політичної влади та громадянського суспільства визначає якість існуючої моделі державно-громадського управління, яка має безпосередній вплив на процес державотворення.

The article is devoted to the analysis of the theoretical and legal aspect of the interaction between political power and civil society. It was found that the interaction between political power and civil society is constantly gaining political sharpness and relevance, because the government cannot function effectively without mutual understanding and constructive interaction with civil society. Law-regulatory functions in relations between political power and civil society are defined. It has been found that currently in Ukraine the processes of both the formation of a democratic legal state and the institutionalization of civil society are taking place almost simultaneously, mutually complementing each other. The interaction between political power and civil society consists of two mutually responsible influences - the state on civil society and civil society on the state. Scientific views on the specificity and relevance of the interaction between political power and institutions of civil society are analyzed. It was established that the relationship between political power and civil society can be balanced only under the condition of “maturity” of civil society. Political activity of the public is a sign of a developed civil society and, accordingly, the foundation of democracy. It is theoretically substantiated that the main principles of interaction between political power and civil society include social partnership, ensuring equal opportunities, mutual responsibility, openness and transparency, non-interference, recognition by state authorities of various types of activities of public associations, increasing the effectiveness of the interaction process. The concept “vigorous civil society always weakens rather than strengthens democracy” is analyzed. The main reasons that prevent the proper interaction of the political authorities with the public are highlighted. It is substantiated that it is the effectiveness of the interaction between political power and civil society that determines the quality of the existing model of state-public administration, which has a direct impact on the process of state formation.
