The irreversibility of Ukraine’s European and Euro-Atlantic course and features of the European model of constitutionalism

Abstract

Стаття присвячена уточненню особливостей європейської моделі конституціоналізму. Уточнено, що такими особливостями є: ідеологія ліберальної демократії, доповнена ідеями соціальної держави; об’єктивний конституційний порядок; організаційні та функціональні принципи конституційного механізму державної влади. Уточнено організаційні принципи конституційного механізму державної влади: єдності та розподілу державної влади; народного суверенітету; гласності; верховенства права; юридичної рівності суб’єктів конституційного механізму державної влади; демократизму механізму державної влади; легітимності конституційного механізму державної влади; ідеологічного багатоманіття та політичного плюралізму; територіального устрою. Уточнено функціональні принципи конституційного механізму державної влади: компетентності та професійності; оптимальності й ефективності; стимулів та обмежень; реальності та економності; підзвітності; субсидіарності; колегіальності та єдиноначальності; самостійності державних органів і незалежності громадських організацій; інші.

The article is devoted to clarifying the features of the European model of constitutionalism. It is specified that such features are: the ideology of liberal democracy, supplemented by the ideas of the welfare state; an objective constitutional order; organizational and functional principles of the constitutional mechanism of state power. The organizational principles of the constitutional mechanism of state power are specified: unity and division of state power; people’s sovereignty; publicity; the rule of law; the legal equality of the subjects of the constitutional mechanism of state power; democracy of the mechanism of state power; legitimacy of the constitutional mechanism of state power; ideological diversity and political pluralism; territorial structure. Functional principles of the constitutional mechanism of state power have been clarified: competence and professionalism; optimality and efficiency; incentives and restrictions; reality and economy; accountability; subsidiarity; collegiality and unity; independence of state bodies and independence of public organizations; others.
