Нормативно-правове регулювання доходів від операцій із криптовалютою

Abstract

У статті розглянуто законопроекти, які спрямовані на регулювання відносин із цифровими активами в Україні. Проаналізовано функціонування наявного ринку криптовалюти з виділенням основних переваг і недоліків. Встановлено, що криптовалюту регулює велика кількість правових та нормативно-правових актів, законів, проте немає єдиного уніфікованого стандарту з регулювання операцій із криптовалютою. Наведено порівняння законопроектів № 7183, 7183-1 та № 4328 та характеристик цих законопроектів із регулювання обігу криптовалюти. Наведено приклад щомісячного звіту про прибуток від майнингу, який отримує кожен майнер. Розглянуто функціонування криптосистеми, яке наведено у положенні про порядок здійснення криптографічного захисту інформації в Україні. Встановлено, що криптовалюти як такі не є криптосистемами відповідно до чинного законодавства. Тобто під час створення нової криптовалюти отримувати дозвіл не потрібно, проте, якщо особа бажає здійснювати майнинг будь-якої криптовалюти, необхідно отримати ліцензію.

The article considers bills aimed at regulating relations with digital assets in Ukraine. The functioning of the existing cryptocurrency market is analyzed, highlighting the main advantages and disadvantages. The study allows us to establish that the use of cryptocurrency in the financial turnover of the state has a melting trend in the future. Regulatory and legal regulation of such assets in our country will allow to receive additional income from such operations with cryptocurrency as mining, exchange and sale. It is established that cryptocurrency is regulated by a large number of legal and normative legal acts, laws, but there is no single unified standard for regulating cryptocurrency transactions. A comparison of bills № 7183, 7183-1 and № 4328 and the characteristics of these bills on the regulation of cryptocurrency circulation is given. The study showed that in Ukraine there is a basis for the implementation of cryptocurrency in financial and economic turnover. The country has all the infrastructure to officially engage in activities related to the following assets: creators of new cryptocurrencies, manners, cryptocurrency exchanges, buyers and sellers of cryptocurrencies. However, it has been established that the cryptocurrency market remains an unregulated area, as the state has not yet defined the relevant market as a separate area of public relations and has not described it in any way; has not established and does not separately exercise its powers to regulate activities in the cryptocurrency market; has not defined the individual rights, obligations and responsibilities of individuals and legal entities that participate in market activities in various forms and act in different roles of stakeholders. An example of a monthly report on mining profits that each miner receives is given. The functioning of the cryptosystem is considered, which is given in the regulations on the procedure for cryptographic protection of information in Ukraine. It is established that cryptocurrencies as such are not cryptosystems in accordance with current legislation. That is, when creating a new cryptocurrency, you do not need to obtain a permit, but if a person wants to mine any cryptocurrency, you must obtain a license.
