Оцінка впливу окремих норм законодавства на практичну діяльність у сфері туризму

Abstract

У статті досліджуються питання сучасних аспектів функціонування туристичної сфери України. Розкриваються існуючи проблеми правового регулювання туристичної галузі, окреслюються та аналізуються практичні питання у сфері валютного регулювання та оподаткування туроператорів, турагентів та вплив на діяльність і конкурентоздатність учасників ринку. Метою статті є визначення основних тенденцій, що відбуваються в туристській галузі України, та чинників, що впливають на неї. Автори відзначають, що нормативно-правова база, яка регулює здійснення туристичної діяльності в Україні, є дуже недосконалою і потребує подальшого розвитку й удосконалення, приведення її у відповідність із міжнародно-правовим нормами, правилами і стандартами з урахуванням найкращих національних традицій правового регулювання.

The article examines the issues of modern aspects of the functioning of the tourism sector in Ukraine. Reveals the existing problem s legal regulation of the tourism industry are identified and analyzed practical issues in the field of currency adjustable and taxation of tour operators, travel agents and its impact on the operations and competitive market participants. The aim of the article is the determination the basic tendencies and the tourist industry of Ukraine and the factors influencing it. Based on the experience of different countries, it is possible to say that the success of the development of tourism is directly dependent on the order both at the state level, perceived this sector, as it enjoys public support, how the government responds to the changes occurring in the global economy, securing his reaction to the corresponding normative legal acts, based on the practical experience of subjects market. The authors note that the legal framework governing the implementation of tourist activities in Ukraine is very imperfect. Adoption of amendments 18.11.2003 to the law in Ukraine «On Tourism» from 15.09.1995 entailed a significant decrease in demand for domestic tourism, the subjects of which were not ready to compete with foreign resorts not in terms of service level, not in terms of the comfort of providing a comprehensive package of services. According to the aforementioned law , domestic tourism is defined as a priority, but no specific support in bylaws and regulations has been developed or implemented. The authors emphasize that today there is no doubt about the need for serious rational changes in the current legislation regulating the tourism industry, which should ensure the functioning and overcoming the crisis. The regulatory framework requires further development and improvement, bringing it into line with international legal norms, rules and standards, taking into account the best national traditions of legal regulation. Any law must have an unambiguous interpretation and contribute to the development of the industry, taking into account the interests of all its subjects.
