Право на заповіт та окремі питання його реалізації

Abstract

У статті аналізуються теоретичні аспекти реалізації особою права на заповіт та особливості реалізації запові- тів, що посвідчені нотаріально, а також іншою посадовою, службовою особою. Звертається увага на особливості практичного застосування окремих положень чинного законодавства під час нотаріального посвідчення заповіту. Особлива увага приділяється реалізації права подружжя на заповіт. Ключові слова: нотаріальне посвідчення, посвідчення заповіту іншою посадовою, службовою особою, заповіт подружжя, нікчемний заповіт.

The article is analyzed the theoretical and practical aspects of the implementation of the right to a person of testament and features of the implementation testaments attested by a notary, other officials, service person, worthless testament. Attention is drawn to the peculiarities of the practical application of certain provisions of the current legislation in the notarization of the testament. Particular attention is paid to the realization of the right to marriage testament.
