Abstract: | Annotation. The subject of the legal recognition and provision of the state border is one of the acute issues that has become the cornerstone of state integrity, sovereignty and security. The state border as a sign of state sovereignty is the primary basis for the territorial determination of the state, its place and role on the political and economic map of the world. The lack of proper legal regulation of the state border became the reason for the aggression and occupation of the Ukrainian territory by the Russian Federation, and as a result, a large-scale war broke out. On the one hand, there is war, and on the other, there is the need to solve a number of related problems, in particular, combating illegal migration, illegal activities on the common state border with neighboring countries. Ukraine and its regions have been trying to develop cross-border cooperation and border infrastructure, establish good-neighborly relations and cooperation with neighboring states for a long time. One of the European tendency in the development of the border relations between the EU and third countries is the creation of joint checkpoints. At the same time, emphasis is placed on the need for the parties to clearly comply with the requirements of European legislation and the Schengen Borders Code when preparing draft international agreements between EU member states and third countries. Taking into consideration that the external border of EU member states is the customs border of the European Union, it cannot impede trade, social, cultural and regional cooperation. This proves the relevance of the issue of national legislation unification with international legal norms of the European Union in this field. The beginning of the long way to membership in the European Union for Ukraine began with its obtaining the status of a candidate country for joining the EU in the spring of 2022. The first steps in the direction of accelerating the country’s integration into the European space are the elimination of barriers associated with border crossing. |
