Щодо питання про захист прав інвесторів в ЄСПЛ

Abstract

Захист прав інвесторів в сучасному європейському правовому просторі викликає значний інтерес серед вчених, практиків та громадськості. Європейська конвенція про права людини (ЄКПЛ) та діяльність Європейського суду з прав людини (ЄСПЛ) встановлюють важливі стандарти щодо захисту особистих, політичних, соціальних та економічних прав громадян, у тому числі прав інвесторів. Цілісність та ефективність правового захисту інвесторів стає ключовим елементом для забезпечення правової стабільності та розвитку економічних відносин у Європейському Союзі та країнах, що прагнуть до набуття членства в ньому. Підвищення рівня захисту прав інвесторів сприяє розвитку бізнесу, привабленню іноземних інвестицій, а також підвищенню довіри до правової системи. У цьому контексті наукове дослідження присвячене аналізу сучасного стану та перспективам захисту прав інвесторів в рамках ЄСПЛ. Проведення аналізу практики суду, визначення проблем та викликів, а також пошук шляхів вдосконалення правового захисту інвесторів є актуальним завданням, спрямованим на забезпечення дальшого розвитку європейського правового простору та забезпечення високого рівня захисту прав людини в контексті економічних відносин. З врахуванням значення інвестицій для економічного розвитку та забезпечення правової стабільності, дослідження спрямоване на ретельне розглядання основних положень Європейської конвенції про права людини стосовно прав інвесторів та аналізу практики суду в цьому питанні. Робота визначає ключові виклики та недоліки у захисті прав інвесторів в контексті ЄСПЛ, а також пропонує можливі шляхи вдосконалення правового захисту з метою забезпечення високого рівня захисту прав людини в економічних відносинах. Ця аналітична робота має значення для вчених, практиків та законодавців, що цікавляться забезпеченням правового захисту інвесторів у межах Європейського Суду з прав людини.

The protection of investors’ rights in the modern European legal space is of great interest among scientists, practitioners, and the public. The European Convention on Human Rights (ECHR) and the activities of the European Court of Human Rights establish important standards for the protection of personal, political, social, and economic rights of citizens, including the rights of investors.The integrity and effectiveness of legal protection of investors becomes a key element for ensuring legal stability and development of economic relations in the European Union and countries seeking to become members of it. Increasing the level of protection of investors’ rights contributes to business development, attracting foreign investments, as well as increasing confidence in the legal system.In this context, the scientific study is devoted to the analysis of the current state and prospects for the protection of investors’ rights within the framework of the ECHR. Conducting an analysis of court practice, identifying problems and challenges, as well as finding ways to improve the legal protection of investors is an urgent task aimed at ensuring the further development of the European legal space and ensuring a high level of human rights protection in the context of economic relations.Taking into account the importance of investments for economic development and ensuring legal stability, the study is aimed at a thorough examination of the main provisions of the European Convention on Human Rights regarding the rights of investors and an analysis of court practice in this matter. The work identifies key challenges and shortcomings in the protection of investors’ rights in the context of the ECHR and also suggests possible ways to improve legal protection to ensure a high level of protection of human rights in economic relations. This analytical work has implications for scholars, practitioners, and legislators interested in ensuring the legal protection of investors within the European Court of Human Rights.
