Особливості інституту президента в Греції

Abstract

Проаналізовано особливості інституту президента в Греції. У Греції центром здійснення державної влади виступає не глава держави і не парламент, а уряд, глава якого фактично є першою особою в державі. У статті з’ясовано особливості президентських виборів. Обраний парламентом президент не має вагомих владних повноважень. Повноваження Президента Греції систематизовано відповідно до основних сфер державної діяльності – виконавчої, законодавчої, судової, зовнішньополітичної, національної безпеки та оборони. До повноважень Президента Греції у сфері виконавчої влади належать: формування уряду; відправлення у відставку уряду, але із санкції самого уряду; участь у призначеннях глав місцевих органів виконавчої влади; відзначення державними нагородами, присвоєння почесних і вищих військових звань. До повноважень Президента Греції у сфері законодавчої влади належать: скликання позачергових сесій парламенту; розпуск парламенту; підписання та оприлюднення прийнятих парламентом законів; застосування вето щодо прийнятих парламентом законів; відсутність права законодавчої ініціативи; видання власних нормативно-правових актів. До повноважень Президента Греції у сфері судової влади належать право на помилування, пом’якшення і скасування кримінальних покарань, визначених судом, оголошення амністії, призначення на судові чи вищі судові посади. До повноважень Президента Греції у сфері зовнішньої політики належить право представляти державу в міжнародних відносинах, укладати міжнародні договори, призначати і відкликати послів та інших дипломатичних представників держави в інших державах, приймати вірчі і відкличні грамоти дипломатичних представників іноземних держав. У сферах національної безпеки та оборони держави Президент Греції очолює збройні сили держави, керівництво якими належить уряду.

The features of the president’s institute in Greece are analyzed. In Greece, the center of state power is not the head of state or the parliament, it is the government, the head of which is actually the first person in the state. The features of the presidential election are analyzed in the article. The president elected by parliament has the unimportant power. The powers of the President of Greece are systematized in accordance with the main spheres of state activity – the executive, the legislative, the judicial, the foreign policy, the national security and the defense. The powers of the President of Greece in the field of the executive power include: forming the government; dismissal of the government, but with the sanction of the government itself; participation in the appointment of heads of local executive bodies; awarding state awards, awarding honorary and higher military ranks. The powers of the President of Greece in the field of the legislative power include: convening extraordinary sessions of the parliament; dissolution of the parliament; signing and promulgation of laws passed by the parliament; veto on proposed laws; lack of the right of legislative initiative; publication of own regulations. The powers of the President of Greece in the field of the judiciary include the right to pardon, mitigate and abolish criminal penalties imposed by a court; to proclaim amnesty; appointment to judicial or higher judicial positions. The powers of the President of Greece in the field of the foreign policy include the right to represent the state in international relations, to conclude international agreements, to appoint and recall ambassadors and other diplomatic representatives of the state in other states, to accept credentials and letters of revocation of foreign diplomats. In the fields of the national security and defense, the President of Greece is head of the armed forces of the state, led by the government.
