Концепція регіонального розвитку щодо захисту прав національно-етнічних меншин

Abstract

Стаття присвячена питанню регіонального розвитку та адаптивності захисту прав національно-етнічних меншин на регіональному, територіальному та локальному рівнях. Запровадження нового підходу регіональної політики. Формування оновленої моделі державотворення. В результаті дослідження складений план розвитку поліетнічних регіонів з урахуванням усіх аспектів децентралізації. Задля досягнення поставленої мети були розглянуті основні етапи реформи децентралізації, динаміка фінансування етнічних територій в Одеській, Чернівецькій та Закарпатській областях. З’ясовані ключові закони, декларації та угоди, котрі ратифіковані на міжнародному рівні і задекларовані Рамковою конвенцією по захисту національних меншин. Висвітлені акти правового регулювання, європейські та світові норми, що мають сприяти цільовому і безпечному регіональному функціонуванню, соціальному та освітньому розвитку, збереженню етнічної, релігійної самобутності меншин. Розкрита ідея затвердження на державному рівні закону, який буде охоплювати сфери міжетнічних відносин у громадах, оскільки етнонаціональна політика є однією з характерних складових процесу децентралізації та надійною платформою європейського майбутнього. Окрім законодавчого забезпечення, є необхідним прийняття закону щодо корінних народів України, закріплення мовних прав цих суб’єктів національних відносин, а саме: право на розвиток рідної мови, право на спілкування рідною мовою, право на вивчення рідної мови. На основі даних Державної стратегії регіонального розвитку 2021-2027 рр., був розроблений план заходів у фінансово-економічній, соціально-культурній та управлінській сферах. Слід зазначити, що оновлена модель фінансового забезпечення дає можливість підвищити фінансову спроможність громад, налагодити структурні підрозділи для ефективного розвитку поліетнічних регіонів. Така тенденція прогнозування набуде нового регіонального статусу у питанні прав національно-етнічних меншин.

The article is devoted to the issue of regional development and adaptability of protection of the rights of national and ethnic minorities at the regional, territorial and local levels. As a result of the study, a plan for the development of polyethnic regions was drawn up, taking into account all aspects of decentralization. In order to achieve this goal, the main stages of decentralization reform, the dynamics of funding of ethnic territories in Odessa, Chernivtsi and Zakarpattia regions were considered. The key laws, declarations and agreements ratified at the international level and declared by the Framework Convention for the Protection of National Minorities have been clarified. Acts of legal regulation, European and world norms that should promote targeted and safe regional functioning, social and educational development, preservation of ethnic and religious identity of minorities are covered. The idea of approving a law at the state level that will cover the spheres of interethnic relations in communities has been revealed, as ethno-national policy is one of the characteristic components of the decentralization process and a reliable platform for the European future. In addition to legislative support, it is necessary to adopt a law on the indigenous peoples of Ukraine, consolidate the language rights of these subjects of national relations, namely: the right to develop their native language, the right to communicate in their native language, the right to learn their native language. Based on the data of the State Strategy for Regional Development 2021-2027, an action plan in the financial, economic, socio-cultural and administrative spheres was developed. It should be noted that the updated model of financial support provides an opportunity to increase the financial capacity of communities, to establish structural units for the effective development of polyethnic regions. This trend of forecasting will acquire a new regional status in the issue of the rights of national and ethnic minorities.
