Функціонування інституту громадських рад у форматі дослідницької стратегії нового інституціоналізму політичної науки

Abstract

У статті автор робить спробу змістовного аналізу сутності інституту громадських рад, що може бути реалізований за використання методологічного інструментарію політичної теорії нового інституціоналізму. Цей напрям інституціоналізму був розвинений на основі досліджень демократичного транзиту, що дозволяє вивчати вплив на політичний процес структур, які не є безпосередньо органами влади. Держава та її установи як центральний інститут політичної системи суспільства залишається важливим предметом політичного дослідження, поряд з цим в якості не менш впливових починають розглядатися структури, що не є складовими держави, але реалізують політичну владу. В результаті проведеного дослідження стає можливо стверджувати, що однією із проблем функціонування громадських рад є їх фактична напівформальна інституціональна природа. Демократична ініціатива впроваджується у низхідному напрямку і ми отримуємо інституціональний трансформ – напівформальний політичний інститут, що покликаний виконувати безперечно важливі і необхідні суспільні функції, але не може визначатися як цілком громадянський. Складно реалізувати ефективну контролюючу діяльність, якщо цей інститут є приналежним до державних структур, а його робота характеризується як форма їх зв’язків з громадськістю. Автором підкреслюється, що особливого значення це набуває стосовно тих громадських рад, які перевіряють на відповідність чинному законодавству діяльність органів влади, що можуть у встановленому законом порядку обмежувати права і свободи людини і громадянина. Так, Громадська рада при Міністерстві внутрішніх справ України викликає значну зацікавленість з огляду на обсяг і вплив повноважень відповідного Міністерства. Громадський контроль як елемент контрольних повноважень даного інституту здійснюється шляхом реалізації комплексу загальних та спеціальних процедур. Суспільні очікування щодо виконання в повній мірі покладених на такі структури завдань роботи вимагають суттєвого сприяння означених органів держави, що не завжди може визнаватися такими за необхідне в політичних системах, які перебувають в процесі демократичної трансформації.

In the article the author tries to make a meaningful analysis of the essence of the institution of public councils, which can be realized using the methodological tools of the political theory of the new institutionalism. This direction of institutionalism was developed on the basis of studies of democratic transit, which allows us to study the impact on the political process of structures that are not directly authorities. The state and its institutions as the central institution of the political system of society remains an important subject of political research, at the same time as no less influential structures are beginning to be considered that are not part of the state, but exercise political power. As a result of the study, it becomes possible to argue that one of the problems in the functioning of public councils is their actual semi-formal institutional nature. Democratic initiative is being implemented in a downward direction and we are receiving an institutional transformation – a semi-formal political institution that is designed to perform undoubtedly important and necessary social functions, but can not be defined as entirely civic. It is difficult to implement effective control activities if this institution belongs to state structures, and its work is characterized as a form of their public relations. The author emphasizes that this is especially important for those public councils that check the compliance of current legislation with the activities of public authorities that may in the manner prescribed by law restrict the rights and freedoms of man and citizen. Thus, the Public Council under the Ministry of Internal Affairs of Ukraine is of considerable interest given the scope and impact of the powers of the relevant Ministry. Public control as an element of control powers of this institute is carried out through the implementation of a set of general and special procedures. Public expectations for the full implementation of the tasks assigned to such structures require significant assistance from these state bodies, which may not always be recognized as necessary in political systems that are in the process of democratic transformation.
