Взаємодія медіа та судової влади в Україні в умовах війни

Abstract

Стаття присвячена аналізу взаємодії медіа та судової влади в Україні в умовах війни, спричиненої агресією російської федерації. Оскільки війна суттєво вплинула на функціонування судової системи та роботу медіа, створивши нові виклики, такі як руйнація судової інфраструктури, евакуація суддів, обмеження доступу до інформації, тиск на медіа, самоцензура та поширення дезінформації, важливо виробити механізми для протидії дезінформації та фейкам, щоб захистити незалежність судів та верховенство права, забезпечити неупереджене та об’єктивне висвітлення судових процесів.Одним із прикладів успішної протидії дезінформації є проєкт «STOPFAKE», який публікує розслідування та спростування фейків про Україну, співпрацюючи з міжнародними медіаорганізаціями. Стаття також аналізує наявні механізми захисту інформаційного простору України та пропонує їх удосконалення. Зокрема, пропонується створення спеціалізованих навчальних програм для журналістів з медіаграмотності та фактчекінгу, впровадження технологій штучного інтелекту для автоматичного виявлення фей-ків, посилення співпраці між державними органами, медіа та громадськими організаціями. Наголошено, що для підвищення довіри громадян до судової системи важливо забезпечити безперешкодний доступ журналістів до судових засідань та можливість об’єктивного висвітлення розгляду справ. Відкритість судових процесів через медіа сприятиме прозорості та підзвітності судової системи. Запропоновано заходи для мінімізації негативних наслідків війни та максимізації позитивних, які включають публікацію судовими органами інформації про свою роботу, розробку етичних норм для журналістів, створення мобільного додатку для судової системи та впровадження нових підходів для протидії дезінформації. Ці кроки сприятимуть зміцненню співпраці між судами та медіа, що є критично важливим для збереження верховенства права та справедливості в Україні в умовах війни.

This article is dedicated to analyzing the interaction between media and the judicial authority in Ukraine amid the war caused by the aggression of the Russian Federation. Since the war has significantly impacted the functioning of the judicial system and the work of the media, creating new challenges such as the destruction of judicial infrastructure, the evacuation of judges, restricted access to information, pressure on the media, self-censorship, and the spread of disinformation, it is essential to develop mechanisms to counter disinformation and fake news. This will help protect the independence of the judiciary and the rule of law, ensuring unbiased and objective coverage of judicial processes.One example of successful counteraction to disinformation is the «STOPFAKE» project, which publishes investigations and refutations of fake news about Ukraine, collaborating with international media organizations. The article also analyzes existing mechanisms for protecting Ukraine’s information space and suggests improvements. In particular, it proposes creating specialized training programs for journalists in media literacy and fact-checking, implementing artificial intelligence technologies for automatic fake news detection, and enhancing cooperation between state authorities, media, and public organizations.The article emphasizes that to increase public trust in the judicial system, it is crucial to ensure journalists have unobstructed access to court hearings and the ability to objectively cover the progress of cases. The openness of judicial processes through the media will promote transparency and accountability in the judicial system. Measures are proposed to minimize the negative consequences of the war and maximize positive outcomes, including the publication of information about the work of the judiciary by the courts, the development of ethical standards for journalists, the creation of a mobile application for the judicial system, and the implementation of new approaches to counter disinformation. These steps will strengthen cooperation between courts and the media, which is critically important for maintaining the rule of law and justice in Ukraine during the war.
