Здійснення права на сімейні форми виховання в умовах воєнного стану

Abstract

Стаття присвячена питанням здійснення права на сімейне виховання в умовах воєнного стану. Наголошено, що принцип пріоритету сімейного виховання дитини нормативно закріплено у сімейному законодавстві України. Сімейне виховання дає можливість забезпечити нормальний фізичний, моральний, інтелектуальний та соціальний розвиток дитини. Підкреслено, що найважливіше завдання держави полягає у виведенні сім’ї зі складних життєвих обставин для подальшого повноцінного піклування батьками про дітей. Особливої гостроти набувають питання здійснення права на сімейні форми виховання у період особливих станів, у тому числі і війни. З початком повномасштабної війни чимало дітей залишилися сиротами або проживають в умовах, які не відповідають потребам дитини. Підкреслено, що аби кожна така дитина отримала турботу, любов та сімейний затишок в нашій державі активно працюють над розвитком сімейних форм виховання та влаштування дітей у родини. Наголошено, що здійснення права на сімейні форми виховання в умовах воєнного стану можна визначити як комплексне право сімейного вихователя та дитини на виховну взаємодію в сімейно-родинних умовах за підтримки з боку громадських та державних інституцій, спрямоване на належне забезпечення інтересів дитини в умовах воєнного стану. Зазначене дозволяє також включити період війни у перелік чинників, що можуть зумовити складні життєві обставини. Підкреслено, що ефективність виконання педагогічних та соціальних функцій у вихованні дітей визначається, серед іншого, міжнародним досвідом, результатами експериментів на території України щодо їх впровадження та дослідженнями українських теоретиків і практиків у сфері охорони дитинства. Остаточно ці питання мають знайти своє відображення у Національному плані сімейного виховання та догляду дітей в Україні. Наголошено, що сьогодні особливо важливим є зміст навчальних програм щодо підготовки кандидатів в сімейні форми виховання та впровадження послуги патронату.

The paper is dedicated to issues on the implementation of the right to family-based forms of education under martial law. It is stressed, the principle of the priority of the family education is ensured normatively in the Family Legislation of Ukraine. Family education ensures a possibility to provide an appropriate physical, moral, intellectual and social development of the child. It is outlined, the most important task of the state is to get the family out of difficult life circumstances for further full-fledged parental care for children. Issues on the implementation of the right to family-based forms of education become especially sharp under specifical circumstances including a war. Since the beginning of the full-scale war, many children have been orphaned or live in conditions that do not meet the needs of children. In our state, work actively for development of family-based forms of education and placement of children in the family to provide care, love and family comfort for every child. It is emphasized, the implementation of the right for family-based forms of education under martial law can be identified as a complex right of the family educator and the child for educative interaction in family conditions with the support of non-governmental organizations and state institutions, aimed at appropriate ensuring interests of the child under martial law. Mentioned above allows to include a war period into the list of circumstances that can cause difficult circumstances of the life. It is outlined, an efficiency of the implementation of pedagogical and social functions during the education of children are determined among others, by the international experience, findings of experiments in Ukraine, and researches of the Ukrainian scientists and practitioners in the field of childhood. At last, issues on the implementation of the right to family-based forms of education under martial law would to be reflected in the National Plan for Family Education and Care of Children in Ukraine. It is stressed, the content of educational programmes for training of candidates for family-based forms of education and implementation of forms of foster care is especially significant.
