Правовий механізм вирішення політичних конфліктів

Abstract

В статті автор визначає предмет та об’єкт політичного конфлікту, його суб’єктів, розкриває особливості, зокрема ті, які вказують, що основним механізмом вирішення політичного конфлікту є право. Зазначається, що політичний конфлікт не може бути зіткненням інтересів окремих осіб, у такому випадку це буде конфлікт політиків. Політичний конфлікт завжди безпосередньо або опосередковано пов’язаний з інтересами великих соціальних груп або суспільства в цілому відтак інституціоналізований. Обґрунтовується також, що способи вирішення політичного конфлікту суттєво залежать від форми політичного режиму. Демократія тяжіє до мирних методів врегулювання конфліктів. Можливі форми прояву політичних конфліктів та способи виходу з них в умовах демократії регламентовані конституцією країни та іншими законодавчими та підзаконними актами. Більшість із них має відкритий, публічний характер. Конкретні способи врегулювання політичних конфліктів звісно залежать від їхнього виду. Найлегше регулюються горизонтальні конфлікти. Якщо під час дискусій, переговорів, роботи погоджувальних комісій не вдається дійти згоди і конфлікт не знаходить свого вирішення, в демократичній політичній системі існують такі способи його розв’язання як звернення до Конституційного Суду, відставка уряду, розпуск парламенту та призначення дострокових парламентських виборів, імпічмент, проведення референдуму. Складніше вирішувати вертикальні статусно-рольові конфлікти, що виникають між центральною і регіональною владою. Регіони можуть претендувати не лише на додаткові повноваження, покращення свого економічного стану, а й прагнути повної незалежності. Найскладнішими для правового врегулювання є вертикальні режимні політичні конфлікти. Метою такого конфлікту, як правило, є зміна існуючої політичної системи. Складність вирішення таких конфліктів полягає в тому, що ініціатор конфлікту може ігнорувати існуючі правила політичної боротьби, ставити під сумнів легітимність законів, вимагати їхньої зміни, діяти протиправними методами. В будь-якому випадку в демократичній політичній системі право виступає безальтернативним механізмом вирішення конфліктів. Тому завдання полягає в розбудові не декларативної, а реальної демократії з розвиненим громадянським суспільством, механізмами контролю влади, учасницькими практиками, верховенством права.

In the article, the author defines the subject and object of the political conflict and its participants. The author reveals the features, in particular those that indicate that the main mechanism for resolving the political conflict is the law. It is noted that a political conflict cannot be a clash of interests of individuals, in which case it will be a conflict of politicians. Political conflict is always directly or indirectly related to the interests of large social groups or society as a whole, hence it is institutionalized. It is also substantiated that the ways of solving the political conflict significantly depend on the form of the political regime. Democracy gravitates towards peaceful methods of conflict resolution. Possible forms of manifestation of political conflicts and ways of getting out of them in the conditions of democracy are regulated by the country’s constitution and other legislative and by-laws. Most of them have an open, public nature. Specific ways of settling political conflicts, of course, depend on their type. Horizontal conflicts are the easiest to regulate. If during discussions, debates, negotiations, and work of conciliation commissions it is not possible to reach an agreement and the conflict does not find its solution, in the democratic political system there are such ways of solving it as an appeal to the Constitutional Court, the resignation of the government, the dissolution of the parliament and the appointment of early parliamentary elections, impeachment, organization and holding of a referendum. Vertical status-role conflicts arising between the central and regional authorities are more difficult to resolve. Regions can claim not only additional powers, and improvement of their economic condition, but also strive for complete independence. Vertical regime political conflicts are the most difficult for legal settlement. The goal of such a conflict, as a rule, is to change the existing political system. The difficulty of solving such conflicts lies in the fact that the opposition party can ignore the existing rules of political struggle, question the legitimacy of laws, demand their change, and act by illegal methods. In any case, in a democratic political system, the law acts as an indispensable mechanism for conflict resolution. Therefore, the task is to build not a declarative, but a real democracy with a developed civil society, government control mechanisms, participatory practices, and the rule of law.
