Проблеми, пов’язані з реалізацією принципу самовизначення народу в сучасному світі

Abstract

В статті розглядається проблематика реалізації принципу самовизначення народу у світлі подій останнього десятиріччя. Проведено порівняльний аналіз референдумів про самовизначення в Косово та Криму та їх відповід- ності нормам міжнародного права. Для подолання проблеми порушення основних принципів міжнародного права і виключення подвійних стандартів застосування принципу самовизначення народів, автор пропонує на основі тлу- мачення цих принципів Міжнародним судом ООН переглянути їх перелік та зміст, а на основі цього рішення внести відповідні зміни до Статуту ООН. Ключові слова: основні принципи міжнародного права, принцип самовизначення народу, не визнані країни, частково визнані країни, референдум про самовизначення.

In the article the problems of the principle of self-determination of the people in the light of the events of the last decade are discussed. A comparative analysis of the referendum on self-determination in Kosovo and the Crimea and their conformity with international law was carried out. To solve the problem of violation of fundamental principles of international law and the exclusion of double standards of the principle of self-determination of peoples, the author offers the International Court of Justice gave their interpretation and on the basis of its decision to review the list and content of the principles and to amend the UN Charter.
