Діяльність українських адвокатів та органів адвокатського самоврядування в умовах повномасштабного вторгнення рф

Abstract

У даній статті розкриваються питання, що пов’язані із особливістю професійної діяльність українських адвокатів (аналізуються основні сфери такої діяльності) та органів адвокатського самоврядування в умовах збройної агресії рф. Акцентується увага на основних напрямках роботи НААУ та інших органів адвокатського самоврядування щодо допомоги адвокатам як у професійній діяльності, так і в їх повсякденному житті в умовах війни.Аргументується позиція за якою, повномасштабна війна вплинула на професійну діяльність кожного українського адвоката, і більшість з них почали здійснювати свою діяльність за правилами воєнного часу, надаючи правову допомогу щодо категорії справ, що є наслідком військової агресії рф. Робиться висновок, що сферами такої діяльності є як забезпечення реалізації соціально-економічних прав осіб, компенсації збитків завданих внаслідок військових дій, так і надання правничої допомоги у справах, які пов’язані із вчинення кримінальних правопорушень проти миру, безпеки та міжнародного правопорядку, зокрема, щодо фіксації фактів, які мають відношення до такого роду кримінальних правопорушень та збору відповідної доказової бази. Вказується на активне використання адвокатами додатку «EyeWitness to Atrocities», створеного за ініціативою Міжнародної асоціації юристів та платформи «warcrimes.gov.ua» – Офісом Генерального прокурора разом з українськими та міжнародними партнерами. Акцентується увага також на діяльності органів адвокатського самоврядування в умовах війни. Робиться висновок, що такими органами було організовано та проведено значну кількість різноманітного роду заходів як щодо підвищення кваліфікації адвокатів щодо вирішення питань захисту прав та інтересів і військовослужбовців, і громадян в умовах війни, так і щодо збору благодійної допомоги щодо матеріальної підтримки адвокатів та їх сімей, які потребують цього. Звертається увага й на діяльність Опікунської Ради, що створена при Національній асоціації адвокатів України.

This article reveals the issues related to the peculiarities of the professional activity of Ukrainian lawyers (the main areas of such activity are analyzed) and the self-government bodies of lawyers in the conditions of armed aggression of the Russian Federation. Attention is focused on the main directions of the work of the NAAU and other bodies of the self-government of lawyers in terms of helping lawyers both in their professional activities and in their everyday life in the conditions of war.The position is argued according to which the full-scale war affected the professional activity of every Ukrainian lawyer, and most of them began to carry out their activities according to the rules of wartime, providing legal assistance in the category of cases that are a consequence of the military aggression of the Russian Federation. It is concluded that the spheres of such activity are both ensuring the realization of social and economic rights of individuals, compensation for damages caused as a result of military operations, and providing legal assistance in cases related to the commission of criminal offenses against peace, security and international legal order, in particular, regarding the recording of facts related to this type of criminal offenses and the collection of the relevant evidence base. It is pointed out the active use by lawyers of the application «EyeWitness to Atrocities», created at the initiative of the International Association of Lawyers and the platform «warcrimes.gov.ua» – by the Office of the Prosecutor General together with Ukrainian and international partners.Attention is also focused on the activities of the self-government bodies of lawyers in the conditions of war. It is concluded that such bodies have organized and carried out a significant number of various types of activities, both in terms of improving the qualifications of lawyers in solving issues of protecting the rights and interests of both servicemen and citizens in war conditions, and in collecting charitable assistance for the material support of lawyers and their families. who need it. Attention is also drawn to the activities of the Board of Trustees, which was created under the National Association of Lawyers of Ukraine.
