Демократизація виборчого процесу як механізм запобігання і протидії політичній корупції в Україні

Abstract

Стаття присвячена дослідженню проблем функціонування політичного інституту виборів у контексті запобігання і протидії політичній корупції в Україні. Автором обґрунтовано, що у нинішніх складних умовах боротьби України за незалежність проти російської агресії дана проблематика зберігає надзвичайно високу актуальність і практичну затребуваність. Метою написання статті стало визначення перспективних напрямків демократизації виборчого процесу як механізму запобігання і протидії політичній корупції в Україні. Проаналізовано нову модель виборчої системи, запроваджену прийняттям Виборчого кодексу України. Окрема увагу автором присвячено аналізу тих її компонентів, що негативно впливають на дотримання принципів рівного і вільного доступу кандидатів і політичних партій до участі у місцевих виборах. Розглянуто актуальні нормотворчі ініціативи з вдосконалення виборчого права та запропоновані конкретні кроки, спрямовані на розв’язання: проблеми дочасної і прихованої передвиборної агітації; усунення несправедливого виборчого бар’єру для самовисуванців на місцевих виборах; мінімізації нерівного доступу кандидатів у депутати місцевих рад до зовнішніх рекламоносіїв під час виборчого процесу. Зроблено висновок, що модифікація виборчої системи і демократизація електорального процесу у напрямі підвищення прозорості електоральних процедур, їх фінансового та матеріального забезпечення, формування виборчих фондів і звітності, інших інструментів доброчесні учасників виборів може стати ефективним засобом для вироблення політичної волі у державного керівництва стосовно запобігання і протидії політичній корупції в суспільстві. Обґрунтовано, що вибори як механізм боротьби з цим негативним соціально-політичним явищем є релевантним тільки у синергії із іншими правовими й політичними компонентами системи запобігання і протидії політичній корупції.

The article is devoted to the research of the functioning the political institution of elections in the context of preventing and countering political corruption in Ukraine. The author proves that in the current difficult conditions of Ukraine's struggle for independence against Russian aggression, this area is extremely relevant and practical. The article emphasizes that Ukrainian political studies pay very little attention to such aspects of improving the efficiency of preventing and countering political corruption system as democratization of electoral system and increasing the transparency of the electoral process. The goal of the article was to identify promising directions of democratization the electoral process as a mechanism for preventing and countering political corruption in Ukraine. The new model of the electoral system introduced by the adoption of the Electoral Code of Ukraine is analyzed. Special attention is paid to the analysis of its components that negatively affect the observance of the principles of equal and inclusive access of candidates and political parties to participate in local elections. The author considers the current rule-making initiatives to improve the electoral law and proposes specific measures aimed at solving: the problem of early and hidden election campaigning; elimination of unfair electoral barriers for self-nominated candidates in local elections; minimization of unequal access of candidates for deputies of local councils to outdoor advertising space during the electoral process. It is concluded that the democratization of the electoral process in the direction of increasing the transparency of electoral procedures, their financial and material support, the formation of electoral funds and reporting, and other instruments of fairness of election participants can be an effective instrument for developing the political will of the state leadership to prevent and combat political corruption in society. It is proved that elections in themselves as a channel for selecting the political elite do not guarantee that a critical mass of highly moral and professional politicians with the appropriate will to fight political corruption will gather in the legislative and executive bodies. It is substantiated that elections as a mechanism to counter this negative socio-political phenomenon is relevant only in synergy with other legal and political components of the system of preventing and countering political corruption. The development of moral and ethical standards of behavior Ukrainian parliamentarians and senior officials is considered as a perspective direction for further research.
