Роль дипломатичної служби в формуванні ефективного державного управління зовнішньою політикою держави

Abstract

У статті досліджується дипломатична служба України як один із важливих структурних елементів в системі органів державного управління України у сучасних міжнародних відносинах. Визначено місце дипломатичної служби в системі органів державного апарату Міністерства закордоних справ України. Проаналізовано різноманітні трактування вітчизняними та іноземними науковцями сутності категорії «дипломатична служба» та «дипломатія». У статті розглянуто становлення діяльності дипломатичних служб України, які є важливою складовою механізму здійснення його зовнішніх зносин. Особливу увагу приділено еволюції договірних засад та завдань, що стоять перед дипломатією України. Оцінена система дипломатичної служби України на сучасному етапі, яка проходить складний процес її вдосконалення для інтеграції в міжнародне співтовариство. Вивчено деякі аспекти управління дипломатичними відносинами, які регулюються Конституцією України та Законами "Про дипломатичну службу України", "Про державну службу", Трудовим кодексом України, Консульським статутом України, а також іншими нормативними актами та існуючі міжнародні договори. Визначено основні елементи діяльності дипломатичних представництв, де основні аспекти роботи базуються на захисті інтересів та законних прав та свобод громадян країни за кордоном та реалізації безпеки суспільства та держави. Досліджено проблеми та надано рекомендації щодо вдосконалення діяльності органів дипломатичної служби на основі аналізу законодавства. Оцінено систему дипломатичної служби України на сучасному етапі, яка проходить складний процес її вдосконалення, задля інтеграції в міжнародне суспільство. Досліджено наслідки від застосування основних складових дипломатичної служби у зовнішній політиці країни в сучасних умовах, які справляють позитивний вплив на авторитет та імідж та формують відповідний образ країни. Описано розробку відповідних пропозицій, в тому числі проєктів законодавчих актів, щодо посилення інституційної спроможності органів дипломатичної служби України, які мають імплементуватися протягом 2020 року.

The article examines the diplomatic service of Ukraine as one of the important structural elements in the system of public administration of Ukraine in modern international relations. The place of diplomatic service in the system of bodies of the state apparatus of the Ministry of Foreign Affairs of Ukraine has been determined. Various interpretations of the essence of the category «diplomatic service» and «diplomacy» by domestic and foreign scholars are analyzed. The article considers the formation of the diplomatic services of Ukraine, which are an important component of the mechanism of its foreign relations. Particular attention is paid to the evolution of contractualprinciples and tasks facing Ukrainian diplomacy. The system of the diplomatic service of Ukraine at the present stage, which is undergoing a complex process of its improvement for integration into the international community, is assessed. Some aspects of the management of diplomatic relations, which are regulated by the Constitution of Ukraine and the Laws "On Diplomatic Service of Ukraine", "On Civil Service", the Labor Code of Ukraine, the Consular Statute of Ukraine, as well as other regulations and existing international treaties. The main elements of the activity of diplomatic missions are determined, where the main aspects of work are based on protection of interests and legal rights and freedoms of citizens of the country abroad and realization of security of society and the state. Problems and recommendations for improving the activities of the diplomatic service based on the analysis of legislation have been studied. The system of the diplomatic service of Ukraine at the present stage, which is going through a complex process of its improvement, for integration into the international community, is assessed. The consequences of the application of the main components of the diplomatic service in the foreign policy of the country in modern conditions, which have a positive impact on the authority and image and form the appropriate image of the country. The development of relevant proposals, including draft legislation, to strengthen the institutional capacity of the diplomatic service of Ukraine, which should be implemented during 2020, is described.
